SUBJECT: EARLY RETIREMENT RESOLUTION NO. 93/204
The Board of Supervisors of Contra Costa County RESOLVES THAT:
I. By Ordinance, the Board of Supervisors has adopted the provisions of Government Code
Section 31641.04, permitting early retirement service credit.
II. Because of impending changes in the manner of performing certain services in the County,
and in order to achieve savings in money and other economic benefits for the County, the
best interests of Contra Costa County will be served by permitting additional service credit
for certain members of the Contra Costa County Employee's Retirement Association
(members) in the classifications within the departments designated on Attachment A as
follows:
a. The provisions of this resolution are applicable to all members permanently appointed
to the job classifications in the departments listed on Attachment A of this resolution
indicated on April 27, 1993.
b. Every eligible member who retires between April 27, 1993 and May 26, 1993 shall
receive two additional years of service credit for Contra Costa County service.
C. Upon demand by the Retirement Association,the County Auditor shall transmit to the
Retirement Fund the amounts determined by the Retirement Board to be the actuarial
equivalents of the differences between the allowances the eligible members receive after
getting the additional service credit hereunder and the allowances each individual
would have received without such credit.
d. On later re-entry into County employment under circumstances otherwise requiring or
permitting membership in the retirement system, any member who has received
additional service credit hereunder shall forfeit such additional service credit, and the
County's payments hereunder shall be refunded, unless the re-entry is the result of a
temporary call-back limited to a maximum of 90 days or 720 hours of service in any
one fiscal year.
e. Provided, nevertheless, that the provisions of this resolution are not applicable:
1. To any member otherwise eligible if such member received any unemployment
insurance payment within six months prior to April 27, 1993.
2. To any member if the member is not eligible to retire without additional service
credit under this resolution.

SUBJECT: IMPLEMENTATION OF EARLY RETIREMENT IN SELECTED
CLASSIFICATIONS IN SELECTED DEPARTMENTS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt the attached Resolution providing for early retirement in selected
classifications in specified departments for the purpose of blunting the
impact of eventual layoffs .
BACKGROUND:
Last year, the State cut local governments by $1 . 3 billion. As a result,
Contra Costa County eliminated approximately $55 million from its budget
shortfall and abolished 606 positions . The elimination of these positions
included 380 layoffs in spite of the fact that there had been a freeze in
effect essentially for the entire fiscal year.
The Governor' s Budget, when it was released on January 8, 1993, called for
an additional $2 . 6 billion cut to local governments for the 1993-94 fiscal
year. This position was reinforced by the Governor on April 14, 1993 in
his remarks to the CSAC Spring Legislative Conference. Both the Assembly
and Senate versions of the budget contain this $2 . 6 billion reduction in
local property tax revenue.
The Governor and the Minority leadership in the Legislature have made it
clear that they oppose continuation of the 1/2 cent sales tax which is due
to expire June 30, 1993 . In addition, they oppose any increases in
existing revenue sources and the imposition of any new revenue sources .
They insist that all of the State Budget deficit be balanced with
expenditure reductions .
In view of the above, we believe that it is only prudent to anticipate and
begin to prepare for devastating reductions to County programs . This
level of reductions to County programs can be achieved only with the
elimination of hundreds of positions, including massive layoffs .

The Board of Supervisors has repeatedly expressed its commitment to taking
every possible step to avoid laying off employees . On February 2, 1993,
the Board directed that a number of personnel-related actions be taken,
all focused on reducing the need for layoffs . One of these directions,
Recommendation #24 , reads as follows :
"Authorize the County Administrator to examine the feasibility of
extending the provisions of early retirement to selected
classifications for specified periods of time. "
The attached resolution is the most recent effort in this direction.
Early retirement has been offered to a wide variety of classifications in
a number of departments over the past few years . Earlier this year, early
retirement was offered to selected classifications in the General Services
Department and most recently to selected classifications in the Fire
Protection Districts.
The classifications listed on the attached resolution generally cover
senior positions in some of the departments which are likely to be facing
layoffs in the coming months . While this is the third time this year that
early retirement has been offered in different departments, it is
certainly not the last time we will be recommending that it be offered
this year, particularly as we get a clearer idea of the extent of
reductions the State will require of us . In addition, we will require
that where an employee accepts an early retirement offer, the position
which is vacated or another position at or close to the same level be left
vacant and/or be eliminated to assist in offsetting the additional funds
which must be deposited with the Retirement Board.
The attached resolution also includes represented classifications in some
departments . We are in contact with the employee representatives to get
their input for additional inclusions.
As these discussions continue, and as the impact of State reductions
becomes more department-specific, we will bring additional resolutions to
the Board covering additional classifications .
At this time, we would recommend that the attached resolution be adopted.
