This resolution reports on, and certifies compliance with, the Materials Diversion Ordinance No. 92-105 adopted by the Board of Supervisors of Contra Costa County in December, 1992 . Sincerely, Sherry Kelly Assistant to City Manager/Deputy City Clerk /smk Enclosures cc: Jim Jakel, City Manager City Council ` v 458 `1/8 RESOLUTION NO. 39-93 REPORTING AND CERTIFYING COMPLIANCE WITH CONTRA COSTA COUNTY'S MATERIALS DIVERSION ORDINANCE NO. 92-105 WHEREAS, the Contra Costa County Board of Supervisors adopted Materials Diversion Ordinance No. 92-105 on December 22, 1992; and WHEREAS, Ordinance No. 92-105 prohibits landfill operators regulated by Contra Costa County from accepting solid waste from haulers of local agencies that have not implemented recycling programs approved and certified by the Board of Supervisors; and WHEREAS, Section 418.10. 608 of Ordinance No. 92-105 requires each local agency, by April 1, 1993, to submit to the Board of Supervisors a certified copy of a Resolution or other official action of each City Council reporting and outlining the programs that serve to meet the requirements of Section 418. 10. 604; and WHEREAS, the City of Martinez has not yet determined whether said Ordinance No. 92-105 is lawful or is an appropriate exercise of the County's authority; however, for the time being and in the interest of comity and goodwill between the City and County, the City is agreeable to providing this Resolution; further provided, however, that by adopting this Resolution the City of Martinez is not waiving, nor shall it be deemed to have waived, any of its rights to contest or challenge the validity, appropriateness or lawfulness of said Ordinance No. 92-105. NOW, THEREFORE BE IT RESOLVED: I. that the City Council of the City of Martinez prior to January 1, 1993 collected at least seven of the twelve materials identified in Section 418 . 10. 604 through a weekly curbside recycling program subscribed to by all single family residences within its jurisdiction. The materials collected through the curbside program are: aluminum cans, clear and colored glass containers, newsprint, PET bottles, clear HDPE bottles, colored HDPE bottles, steel and tin-plated cans, and cardboard. Other- materials collected at the curb, not required by Ordinance No. 92-105, are used motor oil and automotive batteries. 2 . that the City Council as of January 1, 1993 provided all residents of the City of Martinez the opportunity to recycle additional materials through a drop-off program with its solid waste hauler, BFI/Pleasant Hill Bayshore Disposal, Inc. , at a convenient location in Pacheco. In addition to materials collected at the curb, all residents may recycle polystyrene, magazines, mixed paper, chipboard, milk and juice cartons, and latex paint. 3. that the City Council of the City of Martinez has provided free of charge to all residents and non-residents the opportunity to learn home composting of yardwaste through monthly classes which started in January, 1992. BE IT FURTHER RESOLVED that the City Council of the City of Martinez certifies that the recycling programs outlined in this resolution meet and exceed compliance with Ordinance No. 92-105. I HEREBY CERTIFY that the foregoing is a true and correct coy of a resolution duly adopted by the City Council of the City of Martinez at a Regular Meeting of said Council held on the 5th day of April, 1993, by the following vote: AYES: Councilmembers Burt, Farley, Frazer, Vice Mayor Woodburn and Mayor Menesini.
