SUBJECT: Enforcement by the County Health Officer of Health Laws and 1
Regulations Within Certain Contra Costa County Cities
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
REAFFIRM the authorization for the County Health Officer to enforce
health laws and regulations pursuant to Health and Safety Code
Sections 476 and 477 within the following Contra Costa County cities:
Clayton
Lafayette
Orinda
Pleasant Hill
Richmond
San Ramon
E1 Cerrito
II. FINANCIAL IMPACT:
None
III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
Pursuant to Health and Safety Code Sections 476 and 477 , each city
within the County is required to submit a certified copy of a
resolution or an ordinance to the Clerk of the Board of Supervisors
consenting to enforcement by the County Health Officer of health laws
and regulations within the cities. In order for the Health Officer's
services for a city to commence, the Board of Supervisors must
authorize the Health Officer to provide the requested services.
Many of the cities in the County have submitted the requisite
resolutions and/or ordinances to the County over the past several
years, and the Health Officer has then provided the services.
However, some of the city resolutions were never formally accepted by
the County. The Health Services Department and the Clerk of the Board
of Supervisors are attempting to update compliance with the Health and
Safety Code, and approval of this Board Order will formalize the
acceptance of the resolutions received from the cities listed above
and authority for the County Health Officer to provide services to
those cities.

AUTHORIZING .. THE CONTRA COSTA COUNTY HEALTH OFFICER

HEALTH LAWS AND REGULATIONS IN THE CITY OF EL CERRITO I.
WHEREAS, Section 8. 08. 150 of the El Cerrito Municipal
Code .authorizes the Contra Costa County Health Officer to "promote
the enforcement or observance of any law of the state, or of any j
local ordinance ' of the city, or of this code, relating to the i
quarantine regulations, or to the preservation of the public
health, or to the sanitary regulations of the state or city . . . ; j
and
WHEREAS, California Health and Safety Code Section 476
requires that .the, governing body of a city consent by resolution or
ordinance to the county health officer's enforcement of these laws
within the cit ' 'J urisdiction; and
WHEREAS, the Health Services Department of Contra Costa
County has been unable to locate an ordinance or resolution of the
City of El' Cerrito providing such consent; and
WHEREAS, the Health Services Department has requested
that the City of E1 Cerrito enact a new ordinance or resolution to
conform to Health and Safety Code Section 476. i
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of E1 Cerrito: '
1. The Contra Costa County Health Officer is hereby
authorized to enforce and promote in the City of El Cerrito all of
the following:
(a) Orders, quarantine regulations and rules
prescribed by the State Department of Health Services and other
rules and regulations issued under the provisions of the Health and
Safety Code. I
(b) Statutes relating to public health.
2 . The City Clerk is directed to serve a certified copy
of this resolution on the Clerk of the Board of Supervisors of i
Contra Costa County after the date this resolution becomes
effective.
