Specific Request(s) or Recommendation(s) & Background & Justification
I. RECOMMENDED ACTION:
APPROVE Project, and
DETERMINE that the project is a California Environmental Quality Act Class 1 c Categorical Exemption,
and DIRECT the Public Works Director to prepare contract plans and specifications for construction.
DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk.
DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the County
Clerk for filing of the Notice of Exemption.
II. FINANCIAL IMPACT:
The estimated project cost is $1,161,800, funded by Measure C (85%) and SB-300 (15%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes placing an asphalt concrete overlay on Tara Hills Drive in the Pinole area and on
Chesley Avenue and Fifth Street in the North Richmond area.
It is needed to restore the structural integrity of the roadways.

The project has been determined to be in compliance with the General Plan and is exempt from CEQA
because it consists of maintenance activities on existing road surfaces and will not result in any
expansion of use beyond that previously existing. No removal of scenic resources will occur as a result
of the activities.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize
funding.

County File #CP 93-9: The 1993 Overlay/Slurry Seal projects consist of an asphalt concrete, fabric
overlay, or slurry seal treatment to.the existing road surface. The projects may also include one
or more of the following activities: 1) pavement striping/painting messages; 2) minor
reconstruction (i.e., excavating and replacing roadway); 3) street and driveway conforms; 4)
placement of shoulder backing (i.e., rolling loose gravel for shoulder); and 5) utility cover
adjustments. Overlay/Slurry Seal projects may occur on major arterial or commuter routes. If so,
the contractor will be instructed to work only during non-commute hours so as not to interrupt the
flow of traffic, and will phase the work if necessary to minimize disruption to motorists. In
residential areas, the majority of the work will be done during the hours of 9:00 a.m. and 4:00 p.m.
Subject project is described as follows: The 1993 Overlay/Slurry Seal projects may occur on
unincorporated roadways in Contra Costa County.

GENERAL CONSIDERATIONS:

overlay, or slurry seal treatment to the existing road surface. The projects may also include one or
more of the following activities:

The Contra Costa County Community Development Department has completed an initial study of the environmental
significance of the project represented by your pending application bearing County File Number CP 93-9 11993
County Overlay and Slurry Seal, various unincortnorated areas). In conformance with Contra Costa County
Guidelines for implementing the California Environmental Quality Act of 1970(CEQA), it has been determined that
your project will not have a significant effect on the environment. Your project falls within the following category:
(x) AN ENVIRONMENTAL IMPACT REPORT (EIR) IS NOT REQUIRED.
(x) The project is categorically exempt (Class 1c ).
( ) The CEQA requirements are accommodated by the EIR previously prepared for
( ) A statement that an EIR is not required (Negative Declaration of Environmental Significance has
been filed by the Community Development Department (unless appealed).

SUBJECT: MANDATORY REFERRAL FOR GENERAL PLI CONFORMANCE
Community Development staff has reviewed the attached project CP 93- to determine if
mandatory referral for General Plan Conformance, as required by Section 65402 of the Government
Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the following
actions:
(v� This project has been determined to be exempt from 65402 review.
( ') This project has been determined to be exempt from 65402 review in accordance with
the Board of Supervisors Resolution 81/522 because the project involves a road alignment
project of a minor nature.
( ) This project should be referred to the City of for 65402 review.
( ) Community Development staff makes the following attached recommendation which
should be incorporated into the staff report on this matter.
The project needs mandatory referral and County staff will process this project in the following manner:
( ) 65402 review is required. Community Development staff will carry this matter before
the appropriate Planning Commission.
( ) 65402 review must be withheld until completion of an Environmental Impact 1
Report on this project.
