SUBJECT: OAKLEY ROAD RECONSTRUCTION PROJECT - OAKLEY AREA
Project No.: 0662-6134152-91 Task: ACO Account: 3540
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contracts and ACCEPT Grant Deeds dated February 17, 1993,
from Daniel and Virginia Kirby.
B. AUTHORIZE Public Works Director to execute said Right of Way Contracts on behalf of
the County.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check in the amount of $4,000 payable to Daniel and Virginia Kirby, 2351 Oakley
Road, Oakley, CA., 94561, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have above-referenced Grant Deeds recorded in
the Office of the County Recorder.
II. Financial Impact:
Payment totalling $4,000 from Oakley/North Brentwood Area of Benefit funds.
III. Reasons for Recommendations and Background:
This acquisition is required for the horizontal and vertical alignment of Oakley Road between Live
Oak and Empire Avenue in the Oakley area. Payment for property rights being acquired from
APN 041-100-002 equals $1,900; payment for the portion being acquired from APN 041-100-003
equals $2,100.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with approved
plans and specifications.

Real property in the northwest quarter of the northeast quarter of Section 27, Township
2 North, Range 2 East, Mount Diablo Meridian, Contra Costa County, California, being a
portion of that parcel of land described in the deed to Daniel Kirby et ux recorded April
29, 1976 in Volume 7844 of Official Records at page 384, described as follows:
PARCEL THREE A: (Permanent R/W)
Commencing at the intersection of the north line of Section 27 and the northerly
prolongation of the east line of that parcel of land described in the deed to Daniel Kirby
et ux recorded April 29, 1976 in Volume 7844 of Official Records at page 383; thence
southerly along said prolongation, south 00055'05" west 22.50 feet to the south right-of-
way line of Oakley Road, the Point of Beginning; thence from the Point of Beginning,
along said south line, south 89017'35" east 135.00 feet to a point hereinafter referred to
as Point M; thence leaving said south line, south 89000'36" west 135.07 feet to a point
hereinafter referred to as Point F, said point being on the east line of said Kirby parcel
(7844 O.R. 383), thence along said east line, north 00055'05" east 4.00 feet, to the Point
of Beginning.
