Recommended Action: A. APPROVE Right of Way Contracts and ACCEPT Grant Deeds dated February 17, 1993, from Daniel and Virginia Kirby. B. AUTHORIZE Public Works Director to execute said Right of Way Contracts on behalf of the County. C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to issue a check in the amount of $4,000 payable to Daniel and Virginia Kirby, 2351 Oakley Road, Oakley, CA., 94561, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have above-referenced Grant Deeds recorded in the Office of the County Recorder. II. Financial Impact: Payment totalling $4,000 from Oakley/North Brentwood Area of Benefit funds. III. Reasons for Recommendations and Background: This acquisition is required for the horizontal and vertical alignment of Oakley Road between Live Oak and Empire Avenue in the Oakley area. Payment for property rights being acquired from APN 041-100-002 equals $1,900; payment for the portion being acquired from APN 041-100-003 equals $2,100. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with approved plans and specifications.
