REQUEST FOR APPROVAL TO RENEW THREE CHILD CARE PROGRAMS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Authorize the Director of Social Service to submit applications to
the State Department of Education to renew child care contracts for
the period July 1, 1993 through June 30, 1994, and to sign the
state's contracts for the following child care programs:
29-003-47 STATE GENERAL FUND CHILD CARE AND DEVELOPMENT PROGRAM
29-052-2 FEDERAL BLOCK GRANT PROGRAM
29-053-1 FEDERAL TITLE IV-A "AT RISK" PROGRAM
And in addition Authorize the Director of Social Service to sign
the required Certificate of Compliance with Child Care Maintenance
of Effort Requirements for FY 93/94 .
FINANCIAL IMPACT:
The funds being applied for are State and Federal funds. There are
no County costs involved at this time in applying for the contract
renewals. However, when the contract for the State General Fund
Child Care Program is executed, the County will be required to
contribute a Maintenance of Effort (MOE) toward that program in the
amount of $56, 181. The MOE is a long standing requirement for the
State's General Fund Program.
BACKGROUND:
The Social. Service Department has been contracting with the State
Department of Education (SDE) for approximately 23 years to provide
child care services under the State General Fund Child Care and
Development Program. Beginning April, 1992 , the Social Service
Department received funds from the Federal (Alternate Payment)
Block Grant Child Care program, and beginning July, 1992 , the
Department received child care funds under the Federal Title IV-A
"At Risk" program.

The State Department of Education has not as yet disclosed funding
amounts for FY 1993-94, but has invited current contractors to
apply for continuing funding by February 15, 1993 . Funding
allocations for the three contracts for FY 1992-93 totalled
$1, 242 , 477 . It is anticipated that FY 1993-94 funding will be
approximately the same.
The State General Fund Program primarily serves families who
receive Child Protective Services (CPS) . The Federal Block Grant
Program targets Teen Parents, children at risk of abuse and
neglect, and children with special needs. The Title IV-A "At Risk"
Program serves low income working families who would be "At Risk"
of becoming eligible for Aid to Families of Dependent Children
(AFDC) without a child care subsidy.
Approximately 200 families are currently receiving services under
those three programs.

AGREENENT
This Agreement is entered into this day of
1993 by and between the Contra Cost& County
office o Edacat on (CCC0Z) and the County of Contra Costa
(County) for its Probation Department.
1. Tamm. The effective date Of this agreement is hruary 16.. 93
and it terminates t ,n _ 30. 1293 ___ unless sooner term noted an

2. Termination. This contract may be terminated by either party
upon 30 days written notice to the other party.
3. Pammat Limit. CCCOE's total payments to County under this
Agreement shall nnot exceed E 29,224 Subject to the payment
limit, CCCOE shall pay County per month by the
10th day of each month in consideration for County's grovkvion
oZ sach month of service as described below.
4. Provision of Deputy probst on officer. County ahall provide
CCCOB with one (1) half-time County Deputy Probation Officer
(DPO) who shall perform the services designated in paragraph 3
below. County shall assign the ripe to work at CCCOE's Community
Schools.
C. Deouty rXQ&MtLon icer's gu les. The DPO shall screen
puplas, gra -12, re arred by school dietriots, who are
truant, runaway or out of control and on appropriate designates
theta as status offenders under welfare and Institutions Code
section 601 and when appropriate, refer them to the CCCOE's
Coommatty Schools for enrollment pursuant to Education Code
section 1981 (c) . Upon the eArollment in the Community Schools
of a pupil referred by the DPQ, the DF0 shall monitor the pupil's
adjustment and serve as ar consultant with Comm city Schaal staff
and parents. After the pupil's sixth month of enrollment in the
Community Schools, the DPO snail review the pts,gll's designatiQn
as a statue offender and shall recommend continuation in the
Community Schools or reassigment to another program. The DPO
shall &lso perform all of those duties and responsibilities
inoluded an Attachment A hOretor "Ditties and Responsibilities of
DPO assigned to Comity Schoole" which Attachment is
incorporated by reference herein.
d. Selection of DpQ. County sholl be responsible for the
recruitment and selection of the DPO it assigns to the Community
Schools. CCCOE may at any time report. to County its concerns
about the DPO performing services under this agreement.

7. EMIDignsIx Status. The DPO employed in the performance of
sery aes under this contract is a County amployee, and shall not
have, and shall not esquire any workers' compensation coverage,
employment benefit, pension, civil service, or other status or
right which CCCOS centers upon its employees.
B. Suoorvislon. County shall provide primary supervision of the
DPO.

at its Community Schools Office, office space, equipment,
supplias, and access to California Education and Welfare and
Institutions Codes and CCCOS policies and procedures.
11. Re rte. For audit purposes, the DPO will provide CCCOS w4t-h
quarter y reports regarding referral of students to Community
Schools, review of students' status, monitoring of students
enrolled in the Community Schools, and number of students served.

13. Indemnification. a. County shall defend, save haranless and
indemnify t e CCCOR and Its officers, agents and employees from
all liabilities and claims for damages far death, nickname or
Injury to persons or property, including without limitation, all

connected with the operations or the services of the County
hereunder, resulting from the conduct, negligent or otherwise, of
the County, its agents or employees.

claims for damages for death, sickness or in3ury to persons or
property, including without limitation, all connegnential
damages, from any cauoo whatsoever arising from or connected with

agents or expioyees.
14 . APRwriations. All torahs and conditlons of this agreement
are subject to tne continued appropriation and availability of
funds for each party for the perforawncs contemplated herain.
15, Amendments. This agreement may be modified or amended by a

10. Compliance with low. The parties shall be subject to and
comply with all Federal, State and 'loaal lays and regulations
applicable with respect to its performance under this agreement,
Including but not linited to, licensing, employment and
purchasing practices; wages, hours and conditions of omployment,
Including non-discrimination.
17. Nondiscriminatory SogXices. The partion agree that all goods
and aearvicess under this contract shall be available to all
qualified persons regardless of age, sex, race, rerllglon, color,
national origin, or ethnic background, or disability, and that
none shall be used in whole or in part, for religious woraYsip or
1notructlon.
38. isdegende:mt_contractor Status. This agreement in by and
between two independent Contractors and is not intended to and
shall not be construed to create the relationship between the
parties of aggnt, servant, employee, partnOrship, joint venturer
or association.

ATTACHMENT A
DUTIES AND RESPONSIBILITIES OF DPD
4SSIGNED TO COMMUNITY SCHOOLS
The County of centra costa (county) for its Probation Department
and the Contras Costas County Office of Education have entered into
an interagency agreement from February 26, 1993, to June 30, 1993,
in carder to better serve students enrolled in the Community
Schools. The County DPO assigned to this project will be an
integral part of an interagency team consisting of Combunity school
staff and Probation staff.
The primary duties and responsibilities of the DPO are as follows:
A. sunervisiran: The DPO will regularly initiate face-to-face
contacts with students enrolled in the Community Schools. The DPU
will communicate regularly with the students, staff,
parents/guardians, and other concerned parties. The DPO will also
conduct student and/or parent conferences, and maintain on-going
supervision of the students as needed.
B. Monitor: The DPO will monitor students' adherence to their
terms and conditions of probation as set forth in their respective
Juvenile Court orders. Failure to comply with terms and conditions
of probation may result in alternative sanctions or return to
Juvenile Court.
C. Guidance: The DPO will work with students individually and in
small groups to help them develop behaviors and attitudes which
will enable them to succeed in school, vocational and community
settings. The DPO will also participate in problem-solving and
decision-making with students, school and staff, and/or
parents/gua dJan« Issues discussed may include attendance, school
performance, school placement and behavior.
D. gee mme: The DPO will serve as a resource person to
Community School staff. The DPO will be accessible to the
Community School administrator, students, school staff and
parents/guardians of students.
E. Lam: The DPO will serge as liaison between Community
School personnel, county probation department personnel and outside
agencies. The DPo will maintain ties with community agencies and
law enforcement agencies. The DPO will also refer students to
community agencies for specialized services when necessary.
F. amoral Safety: The DPO will work with Community School's
staff to provide aw safe campus environment, and may be called upon
to exercise peace officer's responsibilities insofar as he is
authorised to do so by lacy.
