SUBJECT: Principles of Agreement for the Iron Horse Trail in San Ramon
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
Accept report from the Transportation Committee on the Southern Pacific Right of Way, Iron
Horse Trail,through the City of San Ramon, and Authorize the Public Works Director to proceed
with direction provided by the Committee.
II. Financial Impact:
There is no impact to the County General Fund.
III. Reasons for Recommendations and Background:
The City of San Ramon has requested the trail be placed down the center of the SPROW (100
feet wide) between Bollinger Canyon Road and Pine Valley Road because of electromagnetic
radiation concerns on the east side, and additional construction costs if constructed on the west
side. The County has been reserving the center of the SPROW in the area for future transit
options and felt that possible State, Federal, CEQA, NEPA and Section 4(f) concerns might
preclude transit use of the SPROW within the City if the center of the SPROW, the optimum
location for transit, is used for a recreational trail. After checking with State and Federal
agencies and having completed the San Ramon SPROW property inventory, several issues
surfaced and were presented to the Transportation Committee and the Board on March 23,
1993. On March 30, 1993, County staff reported to the Transportation Committee as follows
regarding resolution of the principles of agreement between the County, the City of San Ramon
and East Bay Regional Park District.

1. The trail can be located in the center of the SPROW and the license agreement with
EBRPD will be amended to specify that the trail location within the SPROW is interim.
2. The County will enter into a side agreement with City of San Ramon that says: A) San
Ramon agrees that the trail location is interim and the City agrees to pay for any
necessary trail relocation once the transit alignment is approved and the transit project
is funded; or B) if Caltrans determines that the trail location within San Ramon precludes
a transit use and demands the return of all or any portion of the grant funds or any other
sanctions, San Ramon will relocate the trail within the CityA*1qQRflF6Qe9ettle the

This policy will apply to other jurisdictions that wish to locate the trail in a location that
possibly interferes with the future transit uses of the SPROW as determined by the
County.
3. The County will work with EBRPD to amend the license agreement to make trail locations
more general within the SPROW.
4. The County shall consider amending the General Plan to emphasize the trail as a
component of the Transportation System. EBRPD supports this proposal as it would
allow them more transportation funding options under ISTEA for the trail. EBRPD has
indicated that it will cooperate in funding a general plan amendment.
5. A reduction of the term of the license was suggested by the FHWA letter as an additional
option the County could take to make the trail less permanent. Any term less than
twenty-five years would seriously reduce the ability of EBRPD to qualify for various state
funding grants, so no change is recommended.
IV. Consequences of Negative Action:
The City of San Ramon may lose its current $75,000 grant to construct a portion of the Iron
Horse Trail if the project is delayed.
