FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS In August, 1989 the Danville Town Council and Board of Supervisors entered into a Memorandum of Agreement (MOA) to undertake a joint- jurisdiction General Plan and project review for a 148-acre site (known as the Del Chase property) straddling the boundary of the County and the Town in the Alamo area. The Plan review was initiated at the request of the property owner, New West Federal Savings & Loan/American Real Estate Group. One purpose of the MOA was to allow both jurisdictions to play decision-making roles in the development review and to allow "for simultaneous and independent processing of the application between the two jurisdictions with coordinated, consistent findings and conditions of approval. " A project was submitted by New West which was the subject of an Environmental Impact Report and which was reviewed by the San Ramon Valley Regional Planning Commission and Danville Planning. Commission. In November 1992 the two Commissions voted to recommend approval of the project for a maximum of 58 units based on a site plan which had been prepared by staff. In December, 1992 the Board of Supervisors voted to support the recommendation of the two Planning Commissions but with certain modifications. Some of the major modifications were as follows: 1. In appearing before the Board, the applicant volunteered a contribution of $1, 000 per (unincorporated) lot to the County Homeless Shelter Improvement Trust Fund. In consideration of this contribution, the Board increased the number of approved residential lots by one to a maximum of 59 . 2 . The Board approved an alternative site plan proposed by the applicant similar to one which had been rejected by the two Commissions. 3 . Consistent with current County fee rates, the Board reduced the park dedication fee contribution from the augmented rate recommended by the two Commissions. Finally, the Board directed staff to report back on the Danville Town Council's review of the Alamo Springs project when that body had had an opportunity to consider the project. Danville Town Council Action The Danville Town Council considered this project in January and February, 1993 . The Town Council approved the project, but Danville's action more closely resembles the approval of the two Planning Commissions. The Town Council approved the site plan recommended by the two Planning Commissions (i.e. , maximum of 58 lots) . The Council action provided for the same (augmented) park dedication fee rate recommended by the two Commissions. The Council approval action was also made contingent on the County modifying its approval to be consistent with the Town of Danville's action. New Prosect Submittal On February 17 , 1993 , New West filed a new application (File #2006- 93) with the Community Development Department to amend the Board's December approval of the Alamo Springs Final Development Plan and Vesting Tentative Map. The new application is seeking to amend the County's approval to make it consistent with the project action of the Town of Danville. The applicant has indicated to staff that even though they are consenting to a scale-back of the project that they still intend to honor their previous commitment to contribute to the Homeless Shelter Improvement Trust. The new application is expected to be scheduled in the near future for noticed public hearing before the Zoning Administrator. RD/aa BDVI/3003-90.RD
