D. DIRECT the Real Property Division to have the above referenced Grant Deeds recorded

II. Financiallmpact:
Payment totalling $11,900 from Oakley/N. Brentwood Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the horizontal and vertical realignment of Oakley Road
between Live Oak and Empire Avenue in the Oakley area.
N. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in the southeast quarter of the southeast quarter of Section 22, Township
2 North, Range 2 East, Mount Diablo Meridian, Contra Costa County, California, being a
portion of that parcel of land described in the deed to Ben S. Romiti recorded March 23,
1987 in Volume 13524 of Official Records at page 818, described as follows:
PARCEL SEVEN: (Permanent R/W)
Commencing at the brass disk at the southeast corner of Section 22; thence along the
south line of Section 22, north 89017'35" west 20.00 feet; thence north 00035'05" east
20.00 feet to the intersection of the north right-of-way line of Oakley Road and the west
right-of-way line of Empire Avenue, the Point of Beginning; thence from the Point of
Beginning, along said west line of Empire Avenue, north 00035'05" east 13.00 feet to a
point hereinafter referred to as Point P; thence leaving said west line, north 87°54'37"west
.290.10 feet; thence south 89054'03" west 355.36 feet to a point hereinafter referred to as
Point 0, said point being on the west line of said Romiti parcel (13524 0.R. 818); thence
along said west line, south 00028'25" west 15.00 feet to the north right-of-way line of

The southerly line of said 10 feet wide temporary construction easement is the line
between Points 0 and P as described in PARCEL SEVEN above.
