MICHAEL WALFORD, CHIEF ENGINEER DATE: March 23, 1993 SUBJECT: Authorize the Chief Engineer to Sign a Letter Agreement and Authorize the Issuance of a Purchase Order to East Bay Regional Park District for Earthwork Required in Conjunction with the Wildcat Creek Trail Project, North Richmond Area, (Project No. 7527- 6D8610) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the Chief Engineer to sign a letter agreement with East Bay Regional Park District (EBRPD) for their performance of earthwork required in conjunction with the Wildcat Creek Trail Project in the North Richmond area. AUTHORIZE the issuance of a purchase order to EBRPD in the amount of $30,000, for the required earthwork. If. Financial Impact: The total earthwork cost of $30,000 will be paid from Flood Control Zone 7. III. Reasons for Recommendations and Background: In accordance with the Corps of Engineers (COE) calculations, the levee along the north bank of the lower reach of the Wildcat Creek flood control project was projected to have a settlement rate of 1.2 feet over 12 years. This settlement would not compromise the channel's capacity to convey a 100-year storm, although it would reduce the amount of available freeboard above the 100-year water surface. The COE maintenance agreement requires the District to raise the top of the levee whenever this settlement occurs. Quever f 1. 17 Authorize the Chief Engineer to Sign a Letter Agreement and Authorize the Issuance of a Purchase Order to East Bay Regional Park District for Earthwork Required in Conjunction with the Wildcat Creek Trail Project, North Richmond Area Page 2 March 23, 1993 EBRPD has designed the Wildcat Creek Trail to be constructed on top of this levee. An EBRPD design survey revealed that this degree of settlement has already occurred in some locations along a 2000 foot stretch downstream of the Richmond Parkway. In order to facilitate construction of the Trail, EBRPD has agreed to raise the top of the levee (to the COE's original design elevation) as part of its Trail construction project. The District has in turn agreed to pay the estimated cost of $30,000, which is considered a maintenance cost. IV. Consequences of Negative Action: If the purchase order is not issued, EBRPD will not be able to raise the top of the levee before it constructs the Wildcat Creek Trail. Thus, when the COE mandates the District to raise the levee top at a later date, EBRPD would be required to reconstruct its new Trail at that time.
