THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on March 23, 1993, by the following vote:
AYES: Supervisors Powers, Bishop, McPeak and Torlakson
NOES: None
ABSENT: Supervisor Smith
ABSTAIN: None
RESOLUTION NO. 93/150
SUBJECT: Completion of Improvements, Road Improvement Agreement for LUP 2108-
86 and Declaring Certain Roads as County Roads, Martinez Area.
The Public Works Director having notified this Board that the improvements for LUP
2108-86 have been completed as provided in the Road Improvement Agreement with
Alfred R. Gonzles heretofore approved by this Board;
NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of March 8, 1993 thereby establishing the six-month terminal period for
the filing of liens in case of action under said Road Improvement Agreement:

BE IT FURTHER RESOLVED that the $9,500 cash security for labor and materials
(Auditor's Deposit Permit No. 170359, dated March 15, 1990) deposited by Gonzales &
Sons Construction be RETAINED for the six-month lien guarantee period until September
8, 1993, at which time the Public Works Director is AUTHORIZED to refund the cash
security less the amount of any claims on file.
BE IT FURTHER RESOLVED that the widening of Arthur Road is ACCEPTED and
DECLARED to be a County road; the right of way was conveyed by separate instrument,
recorded on April 14, 1988, in Volume 14721 of Official Records on page 512.
BE IT FURTHER RESOLVED that there is no one year warranty period required,
and the Public Works Director is AUTHORIZED to refund the $19,000 cash security for
performance (Auditor's Deposit Permit No. 170359, dated March 15, 1990) plus interest
in accordance-with Government Code Section 53079, if appropriate, to Gonzales & Sons
pursuant to the requirements of the Ordinance Code.
