The Public Works Director having notified this Board that the improvements for 5946 have been completed as provided in the Road Improvement Agreement with Hal Porter Development heretofore approved by this Board; NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of January 5, 1993, thereby establishing the six-month terminal period for the filing of liens in case of action under said Road Improvement Agreement: DATE OF AGREEMENT SURETY April 10, 1990 Meritplan Insurance Company Bond No. 04NAA006420 BE IT FURTHER RESOLVED that there is no one year warranty period required, and the Public Works Director is AUTHORIZED to refund the $1,000 cash security for performance (Auditor's Deposit Permit No. 115068, October 14, 1986) plus interest in accordance with Government Code Section 53079, if appropriate, to Hal Porter Development pursuant to the requirements of the Ordinance Code.
