MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: MARCH 16, 1993 SUBJECT: STATE HWY 4/13AILEY RD INTERCHANGE Project No.: 4660-6X4158 Task: ACQ Account: 2260 SPECIFIC REQUEST(S) OR RECOMMENDATION(S)b BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the Public Works Director to EXECUTE, on behalf of the County, a Rental Agreement, commencing February 22, 1993, with Tom Madrid for the premises at 490 Wollam Avenue, W. Pittsburg. II. Financial Impact: Payments required are to come from the State Highway 4/13ailey Rd Interchange projectfund which is 100% reimbursable from the Contra Costa County Transportation Authority. Ill. Reasons for Recommendations and Background: A. The County intends to acquire the land and improvements located at 490 Wollam Avenue for use as rights of way for the State Hwy 4/ Bailey Rd Interchange project as soon as possible. B. Having the County enter into a rental agreement with the landlord will minimize relocation costs that may mature for future occupants, since the County can prevent the units from being occupied again prior to purchase of the property. The owner is in agreement with the County's objectives of having the tenants relocated, the units remaining vacant, the County paying rent on the units as they became vacant, and securing the premises against vandalism, trespassers, or other unauthorized occupants. IV. Consequences of Negative Action: The County could be liable for additional relocation expenses, the property would be exposed to continued vandalism, extensive and continuing dumping of garbage and additional occupancy (both lawful and unlawful).
