SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Uphold the decision of the East County Regional Planning Commission, deny the rezoning. 2. Adopt the findings of the East County Regional Planning Commission as the Board own, attached hereto (Exhibit A) . FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS The background information for this item is contained in the January 11, 1993 staff report to the East County Regional .Planning Commission attached (Exhibit B) to this order. The Planning Commission on January 11, 1993, after taking testimony, recommended denial of the proposed rezoning. The Commission found the proposed application for single family residential does not conform to the General Plan designation of Agricultural lands. The General Plan "Land Use Element" references only Agricultural Districts as being consistent with the Agricultural Lands designation or P-1 (Planned Unit District) . However, the P-1 zoning designation would still require, a 5-acre minimum parcel size. The City of Brentwood originally was opposed to the application due to the lack of urban services and the City's proposed General Plan designated the area as Industrial. The City has recently reconsidered its original designation of Industrial to a low density residential designation and withdraws its opposition. Dennis Barry, Community Development Department, presented the staff report on the request and described the. site location. Mr. Barry commented on the East County Regional Planning Commission' s recommendation for denial of the request and the staff recommendation as listed above. The public hearing was opened and no one appearing to testify, the public hearing was closed. Supervisor Torlakson moved to support the East County Regional Planning Commission decision and deny the request to rezone. IT IS BY THE BOARD ORDERED that recommendations 1 and 2 are APPROVED. ' RESOLUTION NO. 2 - 1993 RESOLUTION OF THE EAST COUNTY REGIONAL PLANNING COMMISSION OF THE COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND RECOMMENDATIONS ON THE REQUESTED CHANGE BY HARRINGTON SURVEYS, INC. (APPLICANT) AND LINDA HASENPUSCH (OWNER) , (2979-RZ) , IN THE ORDINANCE CODE SECTION PERTAINING TO THE PRECISE ZONING FOR THE BRENTWOOD AREA OF SAID COUNTY. WHEREAS, a request by Harrington Surveys, Inc. (Applicant) and Linda Hasenpusch (Owner) (2979-RZ) to rezone land in the Brentwood area from Agricultural District (A-2) to Single Family Residential (R-20) was received on March 17, 1992; and WHEREAS, staff conducted an initial study pursuant to State and County CEQA guidelines. The study indicated the subject property was designated Single Family Residential Low Density (SL) and that the requested rezoning was consistent with said General Plan designation. Following posting and circulation of the Negative Declaration of Environmental Significance, a reinterpretation of the General Plan Designation indicated the subject property was designated Agricultural; Lands; and WHEREAS, staff concluded, the requested rezoning would not generate any significant environmental impacts and that a Negative Declaration would be appropriate; and WHEREAS, after notice was lawfully given, a public hearing was scheduled before the East County Regional Planning Commission on Monday, January 11, 1993; whereat all persons interested might appear and be heard; and WHEREAS, on Monday, January 11, 1993, the East County Regional Planning Commission having fully reviewed, considered .and evaluated all the testimony and evidence submitted in this matter; and NOW, THEREFORE, BE IT RESOLVED that East County Regional Planning Commission recommends to the Board of Supervisors of the County of Contra Costa, State of California, that the rezoning request of Harrington Surveys, Inc. (Applicant) and Linda Hasenpusch (Owner) (2979-RZ) be DENIED for change from General Agricultural District (A-2) to Single Family Residential (R-20) as is indicated on the findings map entitled: Page J-26 of the County's 1978 Zoning Map which is attached hereto and made part hereof; and BE IT FURTHER RESOLVED that the reasons for this DENIAL recommendation are as follows: 1. BE IT FURTHER RESOLVED that the Secretary of the East County Regional Planning Commission shall respectively sign and attest the certified copy of this resolution and deliver the same to the Board of Supervisors all in accordance with the Planning Laws of the State of California. AREA DESCRIPTION The subject property is bordered by properties ranging in size from 1.0. to 4.8 acres, with half-acre lots to the northwest:--The Contra Costa Canal is-to the east: V. PROPOSED PROJECT The applicant is requesting approval to rezone 4.8 acres from A-2 to R-20 for future subdivision purposes. VI. AGENCY COMMENTS A. East Diablo Fire Protection District: See attached. B. Environmental Health Division: Must meet water and sewage disposal requirements of the Division prior to land use application for any subdivision of lands. C. Building Inspection Department: No comments. D. Contra Costa Water District: No comments. E. Public Works Department: No comments. F. City of Brentwood: The City's comments of August 19, 1992 are attached. Briefly, the City did not support the extension of County utilities or the use of new septic systems.within the Brentwood planning area. A subsequent letter of December 23, 1992 indicates the City of Brentwood is in support of the application. VII. STAFF ANALYSIS/DISCUSSION Review of the surrounding area indicates the subject property is bordered by properties zoned A-3 to the north and A-2 to the south, west and east. The General Plan designates the properties to the north, south and east as Agricultural Lands (5 acre minimum parcel size) and Single Family Residential-Low Density to the west. The adjacent parcels range in size from 1 .0 acres to 4.8 acres. The applicant's request to rezone the subject property to R-20 (20,000 square foot parcels) is not consistent with the General Plan Designation of Agricultural Lands which requires a 5-acre minimum for subdivision. Without benefit of a General Plan Amendment to a consistent residential district, the subject property cannot be rezoned to R-20. VIII. FINDINGS A. The proposed rezoning to a single family residential district does not comply with the General Plan designation of Agricultural Lands as required under Section 26-2.18060 ) of the County Ordinance Code. 3 B. The uses authorized or proposed within the residential land district are potentially in conflict with the uses authorized .in .the_adjacent-•agr•icultural districts. C. The City has the following comments. L Initial Study: We did not receive a copy of the Initial Study and mitigation measures 1 proposed for this project.. Please send this at your earliest convenience: 2. Current General Plan: The proposed project is not in the City limits and Sphere of influence of Brentwood. However, the subject property is located within Brentwood's Planning Area and is covered under Brentwood's current General Plan (adopted in 1983). The current General Plan indicates Agricultural Conservation (AC) for this area. I have enclosed a copy of the description of this land use category, a current General Plan map, and a Sphere of Influence Map. The inconsistency with the current General Plan should be analyzed in the_Negative Declaration. 3. Proposed General Plan: The proposed General Plan (which is scheduled for adoption in Spring of '93) indicates an Industrial designation for this. property. Although it is not mandatory to consider proposed plans when preparing a Negative Declaration, it seems appropriate for this project due to the nearing completion date of the proposed General Plan. Y 4. Services: Services are not currently provided to this site. Given that this project is within Brentwood's Planning Area it seems appropriate that services would be provided by Brentwood. Brentwood will only provide services to the site if it is in the City Limits. The City anticipates that the Sphere of Influence and City Limits will eventually include this area. Given this, the City will actively oppose any proposals.which are inconsistent with the current General Plan or the proposed General Plan.
