Oakley area.

BACKGROUND/REASONS FOR RECOMMENDATIONS
Staff has met with representatives of the Hofmann Company to
discuss the status of the park to be constructed as a part of
Subdivision 6333 , also referred to as Vintage Park, Oakley.
Although the Developer expressed some concerns regarding
reimbursement for work completed to date, they did indicate the
status of their efforts to construct the park. The Developer
indicates an intention to complete the improvements by July 1,
1993 . The following remaining issues are being addressed by staff.
1. Credit for street frontage improvements. The Developer's
Representative indicated that they felt that since they had
completed the road, curb, gutter and sidewalk improvements
fronting on the parcel that a pro rata share (60%) of the
costs of those improvements should be credited to the
obligations for the park improvements. The have preliminarily
estimated these costs at approximately $120, 000. 00, which if
credited against the $510, 000. 00 obligation would leave a
remaining obligation of $390, 000. 00. The Developer will
prepare a firm estimate of these improvements costs. The
Developer does not dispute the $510, 000. 00' total obligation
figure.

2 . Credit for fencing. They also indicated a desire to credit
the costs of improved fencing currently constructed along the
northern boundary of the site.
3 . Objection to use of estimated costs. In addition, the
Developer objected to staff's use in the January 28, 1993
board order of the estimated costs as the basis for computing
the park dedication fee amounts and instead requests that the
actual costs of the construction be credited to the
$510, 000. 00.
4. Use of well for irrigation. The Developer objects to the use
of the well for irrigation. The well was constructed by the
School District for irrigation purposes and the Developer
intends to connect to the Oakley Water District facilities.
it would appear that the Developer proposal would have
substantially higher costs over a period of time that the use
of the well.
5. Fencing. The plans proposed by Site Development Consultants
indicate a 6 foot vinyl covered chain link fence on the east
side of the park facing the softball diamond and basketball
courts. The Developer points out that this area will be
adjacent to single family residential lots rear yards which
will be provided with a 6 foot solid wood fence. The
Developer objects to the requirement of paying for two fences.
STAFF DISCUSSION
Staff does not believe that credit should be granted for the street
frontage improvements, since the value of the property was
determined on the basis of an improved parcel. (i.e. The Park
District paid for the street frontage improvements as part of the
value of the park site. ) Furthermore, these frontage improvements
are required as part of the overall subdivision improvements
independently of the park. Staff would not object to crediting the
actual costs documented for fencing already installed.
Staff agrees that the remaining obligation to be paid on park
dedication fees should be based on actual costs incurred rather
than estimated costs.
Staff believes that the long term least cost solution to irrigation
of the park landscaping is through connections to the existing well
rather than purchase of potable water from the Oakley Water
District.
Staff concurs with the Developer that an appropriately designed
wooden fence could serve the separation function between the park
and the adjoining residences. The design of the fence would have
to be substantial in order to provide similar long term fencing
functions comparable to that provided by vinyl covered chain link
fencing. Assuming such a design in provided, staff believes that
the requirement of an additional chain link fence would be less
aesthetically pleasing, more difficult to maintain (i.e. , weeds
would grow between the two fences and be difficult to maintain) ,
and ultimately wasteful in terms of redundancy.
ACTUAL VERSUS ESTIMATED COSTS
Staff concurs that actual costs should form the basis of the
computation of Park Dedication fees on the remaining uses.

CONCLUSION
Aside from these few issues, the Developer is generally supportive
of constructing the park per the submitted design as quickly as is
feasible. The Company is currently soliciting bids for the work
and is in discussion with the School District regarding liability
issues and the Public Works Department regarding maintenance
budgeting.
Staff believes that the Developer is proceeding in a responsible
manner to completing the construction work on the park not later 1
than July 1, 1993 . Full utilization of the park will depend upon
the actual timing for the landscaping to be mature enough for
public use without unreasonable damage. The hardscape improvements
associated with the school yard should be available for use
immediately upon the completion of their construction. Because the
developer is showing good faith in moving ahead with procuring bids
on final construction of park design, staff will henceforth limit
its further hold on the project to the refusal to file any further
final maps until the park improvements have been satisfactorily
completed. Therefore, staff will resume issuance of building
permits on earlier phases of the project. Staff is prepared to
make periodic status reports to the Board of Supervisors upon
request.
