SUBJECT: STATUS REPORT - LEASE FOR THE BRENTWOOD WAR VETERANS BUILDING
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDATIONS
1 . That the Brentwood Veterans organizations form a Board
of Trustees for the purpose of signing a new lease with
the County for the Brentwood War Veterans Building.
2 . Accept this report from the General Services Department
regarding the status of the lease for the Brentwood War
Veterans .Building.
II. REASONS FOR RECOMMENDATIONS/BACKGROUND
The Veterans Memorial Buildings were acquired by the County
many years ago to provide facilities for all Veterans
organizations to use. The County' s policy is to lease to a
management Board of Trustees comprised of representatives from
the Veterans organizations that want to use a memorial
building.
For decades, the American Legion was the only active Veterans
group and as such took on the management of the building. The
building has been kept in excellent shape through the Legion's
diligent efforts and through a considerable donation of time
and expertise. The Legion has had a very good record . of ,
leasing and utilizing the building.

BRENTWOOD WAR VETERANS BUILDING
A few years ago another group (VFW) , was organized in Brentwood and
requested access to the building. For several years the County has
had meetings with Brentwood area Veterans organizations to assist
them in resolving their differences so that a Board of Trustees
could be established. The meetings have included the Veterans
organizations, Supervisor Torlakson, and the County's Lease
Management staff. Recently, the use of a Conflict Resolution Panel
was proposed. Only one Veterans association has agreed to use the
panel. To date, the lease for the Brentwood War Veterans Building
has not been signed.
In order to sign the lease the following actions must be
taken:
1 . Building Management. A Board of Trustees for the
Brentwood War Veterans Building must be formed. It is
recommended that the Board include two American Legion
members, one Veterans of Foreign Wars member, one city
representative, and one County representative. This
Board of Trustees shall be the lessee for the building.
2 . Building Manager. The Board of Trustees shall appoint a
Building Manager(s) . Building management issues such as
scheduling the use of the premises, deposits for clean-up,
enforcement of rules (such as the prohibition of smoking) ,
general maintenance, and resolution of any conflicts between
organizations shall be the responsibility of the Board of
Trustees .
3 . Veterans Liability. The Board of Trustees should
incorporate to limit the liability of those individuals
signing the lease on behalf of the Board.
4 . By Laws . The Board of Trustees must develop rules and
regulations to govern the way the Brentwood War Veterans
Building is rented, managed, maintained, and used. These
rules shall be used by the Board of Trustees to resolve
all pertinent Veterans issues.
5 . Accounting of Rents . In accordance with County policy,
an account shall be established solely for the accounting
of rental funds received by the Board of Trustees . These
funds shall be kept separate from all other Veterans ' funds .
6 . Lease Term. A lease term of one year is recommended.
After one year a review shall be conducted to determine
the progress made in resolving issues concerning the
management of the Brentwood War Veterans Building.
Following this review, adjustments can be made in the
composition of the Board of Trustees and the lease will
be renewed.
7 . Deadline. A time period of not more than one month is
recommended to establish the Board of Trustees . If a
Board has not been established, it is recommended that
the Board of Supervisors appoint members to the Board of
Trustees from those Brentwood Veterans organizations
wanting to participate in the operation, maintenance, and
use of the building. The appointed board will be granted
the lease and will then proceed with the above
recommendations .
