RESOLUTION NO. 92/467
SUBJECT: Approval of Second Amendment to Drainage Improvement Agreement for Subdivision 7188,
Danville Area.
On September 18, 1990, this Board approved a Drainage Improvement Agreement with Dame'
Construction Company, Incorporated, developer. The Agreement covers the construction'by Developer
of certain drainage facilities required for Subdivision 7188 (Bettencourt Ranch), and the reimbursement
by District of a portion of the costs of constructing a regional detention basin and outfall pipe. On April
7, 1992,Amendment No. 1 was adopted and both the parties now desire to further amend said Agreement
to reflect changes and include additional construction items that are listed in the "Second Amendment to
Drainage Improvement Agreement."
The Public Works Director having recommended approval of Amendment to Drainage
Improvement Agreement.
NOW THEREFORE BE IT RESOLVED that said Second Amendment to Drainage Improvement
Agreement is APPROVED, the Public Works Director is AUTHORIZED to execute the Amendment on
behalf of the County and the District and the Auditor/Controller is AUTHORIZED to pay $32,606.13 to
Dame' Construction Company, Incorporated.
