FISCAL IMPACT None. If reconsideration is granted the cost of processing: the request will be borne by the applicant. BACKGROUND/REASONS FOR RECOMMENDATIONS On September 10, 1991 the Board of Supervisors considered a request by Joseph and Ivan Cerri to include property : in the Byron area within the Urban Limit Line. The Board of Supervisors indicated that they would not consider the change at that time. On October 4 , 1991 a request for reconsideration was received from the Cerri's based upon a modified proposal to change the Urban Limit Line. As indicated in the attached letter from Scott Gordon, representing Joseph and Ivan Cerri, the requested modification would not result in a net change in the amount of acreage on either side of the Urban Limit Line. The Cerri proposal, if granted for reconsideration, would place the request within Category 4 , which includes requests to be analyzed in a Supplemental Environmental Impact Report. Powers and Members of the Board Contra Costa County Board of Supervisors 651 Pine Street Martinez, California 94553 Re: Request for Reconsideration of Urban Limit Line Determination Joseph and Ivan Cerri Dear Chairman Powers and Members of the Board: The undersigned represents Mssrs. Joseph and Ivan Cerri in connection with their request before your Board to include all or a portion of the + 650 acre Cerri parcel within the Urban Limit Line ("the ULL") . The purpose of this letter is to formally request your Board's reconsideration of this item on your October 8 , 1991 agenda. Your Board previously placed the Cerri request in category 3 , which we believe was in error for the reasons set forth herein. The Cerri proposal, simply stated, is to include all or a portion of the Cerri parcel within the ULL by trading acreage and/or development rights with the adjacent Veale Tract Farms parcel. The Cerri property would be included by taking acreage or development rights from the Veale Tract out of the ULL. The owners of both parcels are desirous of the County evaluating this change in the supplemental EIR to be prepared for proposed ULL adjustments. The proposal would result in no net loss of lands outside the ULL. Inclusion of the Cerri parcel within the ULL will have a net environmental benefit to the County in that Veale Tract lands, especially those in the easterly most portion of that parcel, have development constraints due to environmental, regulatory and topographic considerations, which has prompted the proposal to Chairman Thomas M. Powers and Members of the Board October 3, 1991 Page 2 trade off development rights and/or acreage from this parcel in favor of the Cerri parcel. The Cerri parcel lies wholly above sea level, and is characterized by flat terrain and poor soils quality. The land has little if any agricultural value, but would provide a suitable development site in connection with the adjacent Veale Tract. We respectfully urge your Board to reconsider this proposal and to include it within the EIR scope of study. Thank you for your consideration of this matter.
