SUBJECT: LEGISLATION: SB 1664 (Rogers)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in SUPPORT of SB 1664 by Senator Don Rogers, which
would exempt the County' s First Choice Health Plan from licensure
by the State Department of Corporations until January 1, 1994 .
BACKGROUND:
Under current law, certain Health Care Service Plans are exempt
from licensure by the State Department of Corporations . Among the
requirements in order to be exempt from licensure is that the
health care service plan must be operated by a city, county, public
entity or political subdivision of the State; it must provide
services only to its employees, their dependents and retirees, but
not to the general public; the public entity must provide funding
for the health care service plan; and reimbursement to providers
must be on a fee-for-service basis .
The licensing exemption for these health care service plans expires
December 31, 1992 . The County's First Choice Health Plan is one of
the eligible health care service plans which is currently exempt
from licensure by the State Department of Corporations . During the
period of time that this exemption was in place, the Senate Office
of Research was charged with preparing a report to the Legislature
which was to be filed with the Legislature by December 31, 1991.
It is not clear whether the report has been filed with the
Legislature, but we suspect not since Senator Rogers has introduced
SB 1664 to extend the exemption for another year - until January 1,
1994 .

It is important that the Legislature have the benefit of this study
before determining whether a permanent exemption should be provided
or these plans should be required to be licensed. It is,
therefore, recommended that the Board. of Supervisors adopt a
position in support of SB 1664 by Senator Rogers .
