SUBJECT: LEGISLATION: SB 1878 (Bergeson)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in SUPPORT of SB 1878 by Senator Marian Bergeson,
which would authorize cities and counties to enact ordinances
requiring that any person operating or riding as a passenger on a
bicycle wear a helmet meeting certain specifications .
BACKGROUND:
State law currently requires that any passenger riding on a bicycle
who is less than four years of age or weighs less than 40 pounds
wear a helmet meeting certain specified requirements . There is no
similar requirement which applies to other passengers or to persons
operating a bicycle. In fact, cities and counties are prohibited
from enacting local ordinances addressing subjects contained in the
Vehicle Code.
Senator Bergeson has introduced SB 1878 which, as amended May 13,
1992, would do all of the following:
1 . Specifically authorize cities and counties to enact ordinances
which require that a helmet be worn by any person operating a
bicycle or riding as a passenger on a bicycle.
2 . Such a helmet would have to meet the standards already
specified in the Vehicle Code.
3 . If such an ordinance is enacted, highways which are permitted
for bicycle use and bikeways would have to be posted as
specified notifying bicycle operators and passengers of the
helmet requirement. >�,A

4 . Existing State law dealing with fines for violations of the
existing bicycle helmet law and for dismissal of the charge
upon proof of the purchase of a helmet for the individual in
question would also apply to local ordinances .
The Health Services Director recommends support of SB 1878 for the
reasons outlined in the attached memorandum.
SB 1878 has passed the Senate Transportation Committee and is now
awaiting a vote on the Senate Floor.
For the reasons outlined in the Health Services Director' s
memorandum, it is recommended that the Board of Supervisors vote to
support SB 1878 .
