DATE: May 28, 1992 County q `.°`.'r SUBJECT: LEGISLATION: ' SB 1839 (Petrie) SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position in SUPPORT of SB 1839 by Senator Petris which would provide a tax credit for a taxpayer who replaces a nonfire rated roof with a fire rated roof on a residential property and which would provide for a charitable contribution tax deduction for the 1992 tax year for specified contributions made in support of providing assistance or disaster relief in connection with the Oakland Fire of October 20, 1991 . BACKGROUND: In an effort. to mitigate the financial losses from the Oakland Fire of October 1991, Senator Petris has introduced SB 1839, which, as amended April 20, 1992; would do all of the following: 1 . Allow as a tax credit under the personal income tax law a 15% deduction against the cost paid or incurred during the taxable year to replace a nonfire rated roof as defined by the State Fire Marshal with a fire rated roof on a residential building, providing that local building codes do not already require that a residential building be roofed with a fire rated roof . 2 . Allow a deduction as a charitable contribution for taxpayers who do not otherwise itemize their deductions if the contribution is made for the purpose of providing assistance or disaster relief in connection with the Oakland Fire, providing that the contribution is made between October 20, 1991 and December '31, 1992 . Allow a corporate tax deduction of 5% of a contribution made for the purpose of providing assistance or disaster relief in connection with the Oakland Fire, providing that the contribution is made between October 20, 1991 and December 31, 1992 . In view of the devastation caused by the Oakland Fire, it appears appropriate to support efforts to provide tax incentives for individuals or corporations who made contributions to assist those who suffered losses during the fire as well as to provide a tax deduction for a portion of the cost of installing a fire rated roof where one is not otherwise required at this time. SB 1839 passed the Senate Revenue & Taxation Committee on May 18, 1992 by a vote of 6 : 0 and was scheduled for a hearing in the Senate Appropriations Committee on May 27, 1992 .
