SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. ACCEPT Offer of Dedication of drainage easement made by Garden Creek Development
Company, Inc., as described in Exhibit "A" (attached), which is the area designated as
"Storm Drain Easement" on Lots 1 through 8 of Tract 4295, recorded June 6, 1973, in
Book 157 of Maps at Page 42.
B. ACCEPT Offer of Dedication of drainage easement made by Garden Creek Development
Company, Inc., as described in Exhibit "A" (attached), recorded September 12, 1975, in
Book 7618 at Page 863.
C. DIRECT the Real Property Division to record a certified copy of this Board Order in the
Office of the County Recorder.
I.D. DETERMINE that the activity is exempt from the California Environmental Quality Act
pursuant to Section 15061(b)(3).
E. DIRECT the Director of Community Development to file a Notice of Exemption with the
County Clerk.
F. DIRECT the Chief Engineer to arrange for payment of the $25.00 handling fee to the
County Clerk for filing of the Notice of Exemption.
ll. Financial Impact:
No costs involved.

III. Reasons for Recommendations and Background:
The U.S. Army Corps of Engineers is planning a wildlife mitigation project along a portion of
Green Valley Creek in the Danville area. Their contractor will landscape with native trees and
plant material to restore habitat which was removed during earlier construction of flood control
facilities. The project also includes the installation of irrigation systems for use during the first
three years until plants are established. The Offers of Dedication were made as conditions of
approval for Subdivision 4295 and are now required for the project. The project has been
determined to be in compliance with the General Plan and is exempt from CEQA because the
activity is not a project per the General Rule of Applicability (Section 15061(b)(3).
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with approved
plans and specifications.

Real property in the Rancho San Ramon, City of Danville, Contra Costa County,
California, located in Subdivision 4295 filed June 6, 1973, in Book 157 of Maps, at
Page 42, described as follows:
Those portions of Lots 1, 2, 3, 4, 5, 6, 7, and 8 dedicated for public use and
shown as "STORM DRAIN EASEMENT' on said map (157 M 42).
Together with: Those portions of Lots 1, 6 and 7 of Subdivision 4295 (157 M 42)
dedicated for drainage easements in the Offer of Dedication recorded September
12, 1975, in Book 7618 at Page 863, Official Records of said County.
