RECOMMENDED ACTION: 1. Approve and authorize the Chair to execute on behalf of the County, Standard Agreement #29-469 (State #91-71288) with the State of California, Department of Mental Health, representing the County' s Mental Health Services "Performance Contract" for FY 1991-92, as required by the Bronzan-McCorquodale Act (Mental Health Realignment Legislation) . 2 . Approve and authorize the Health Services Department to budget and expend up to $125, 239 in unexpended FY 1990-91 Categorical SB 155 Supplemental Residential Care Funds for use in FY 1991-92 ("rollover funds") . Of the total $125, 239, $112 ,715 represents State funds in FY 1990-91, and $12, 524 is the required 10% County match. II. FINANCIAL IMPACT: This Contract transmits "un-realigned" State mental health program funds which are still allocated directly to counties by the State for FY 1991-92 , which for Contra Costa County includes the following: FUND STATE/FED. FINANCIAL IMPACT continued: These amounts are included in the Health Services Department Budget for FY 1991-92 . This $ 2 ,505, 131 allocation of State and Federal Funds does not include the $ 112 , 715 in unexpended State Categorical SB155 Supplemental Residential Care Funds which were allocated to the County in FY 1990-91 and which have been "rolled over" for use in FY 1991-92 . III. REASONS FOR RECOMMENDATIONS/BACKGROUND: Board approval of this Mental Health Services Performance Contract is required for the County to retain the above allocations of State and Federal Funds for FY 1991-92 . This Contract essentially replaces the former Annual County Mental Health Short-Doyle Plan and Budget (which is no longer required under the new Mental Health Realignment Legislation) with respect to the programs that are financed by these allocations. The Contract also covers other County Realignment requirements, including maintenance of effort, Short-Doyle Medi-Cal, access to and use of State Hospital and Institutes for Mental Disease, negotiated rates for provider contracts, data collection and reporting, and cost reporting on County mental health programs. Your Board approved the initial FY 1991-92 Mental Health Program Renewal Application for the $1, 475, 000 Federal ADAMHA Block Grant on September 10, 1991, and the Funding Application for the $92,297 Federal "Projects for Assistance in Transition from Homelessness" (PATH) Grant on March 24, 1991. In addition, this Performance Contract continues the provision of categorical funding for the AB3632 Special Education Pupil (SEP) Mental Health Services Program, as well as the County's mental health program allocation of Cigarette & Tobacco Products Surtax Funds, which help to partially finance several County-operated and Con- tractor-operated mental health programs. Prior to the Realignment Legislation, the budgeting and expenditure of the prior year's unexpended SB155 Supplemental Residential Care Rollover Funds would have been included as part of the Board's approval of the Annual County Mental Health Short-Doyle Plan and Budget; but since that document is no longer required, a specific Board approval is recommended for the retention of the $112,715 in unexpended FY 1990-91 Categorical State SB155 Rollover Funds to purchase Level II Supplemental Residential Care Services for eligible mental health clients in licensed Board and Care Facilities in FY 1991-92 . At its meeting on May 28, 1992, the County Mental Health Advisory Board reviewed this FY 1991-92 Mental Health Services Performance Contract and, furthermore, reviewed and approved procedures for ensuring citizen and professional involvement in the mental health services planning process, as required by the Performance Contract and Welfare & Institutions Code Section 5651. 5. The Board Chair should sign twelve copies of the agreement, eleven of which should then be returned to the Contracts and Grants Unit for submission to the State Department of Mental Health.
