SUBJECT: APPROVE AND CERTIFYA NEGATIVE DECLARATION FOR A PROPOSED AMENDMENT
OF A DRAINAGE PLAN AND UPDATE OF THE DRAINAGE FEE ORDINANCE FOR
DRAINAGE AREA 10, DANVILLE CP #92-27
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
FIND, on the basis of the initial study and all comments received, that there is no substantial
evidence that the Drainage Area 10 - Plan Amendment will have a significant effect on the
environment.
ADOPT the Negative Declaration in compliance with the California Environmental Quality Act,
DIRECT the Director of Community Development to file a Notice of Determination with the
County Clerk,
DIRECT the Chief Engineer to arrange for payment of$25.00 to the County Clerk for filing of the
Notice of Determination, and
DIRECT the Chief Engineer to arrange for the $1,250.00 Fish and Game filing fee to be
transferred to the County Clerk.
II. Financial Impact:
None. There is no adverse financial impact on the District by the approval of a Negative
Declaration.

III. Reasons for Recommendations and Background:
Proposed Drainage Area 10 plan amendment and repeal of an existing fee ordinance and
adoption of a new fee ordinance is scheduled for a hearing on July 28, 1992. The plan
amendment will allow construction of drainage improvements to correct localized flooding,
replace inadequate culverts and to correct clogging of culverts by debris. The proposed new
fee ordinance is based on new impervious surface area created. This fee more fairly distributes
the cost of proposed drainage improvements to new developments in Drainage Area 10.
The project has been determined to be in compliance with the General Plan. A Negative
Declaration of environmental significance pertaining to this project was published April 16, 1992,
with no protest, and the Board has considered the Negative Declaration together with all
comments received during the public review period.
IV. Consequences of Negative Action:
Nonapproval of the Negative Declaration will continue the existence of flooding, inadequate
drainage, and nonequitable distribution of fees for new development.
