Ford (dba Innercity Homes Inc. ) for Refund of Building Permits The Board reviewed the report of Franklin Lew, Director of Building Inspection, relative to the request of John K. Ford for a refund of fees paid for building permits issued for the con- struction of three new houses in the North Richmond area. Mr. Lew had recommended denial of Mr. Ford' s request. John K. Ford, 204 Shoreline Court, Richmond, argued against Mr. Lew' s recommendation alleging that the Building Inspection Department had knowledge at the time of issuing the building permits that the State had begun the eminent domain process to acquire the property for the roadway. In response to Supervisor Powers' question, Mr. Lew advised that he was not able to ascertain if his staff had prior knowledge of the State' s intent to acquire Mr. Ford' s property. Board members were in agreement that before making a decision on this matter they should be advised if staff had prior knowledge of the eminent domain proceedings as alleged by Mr. Ford. Therefore, IT IS BY THE BOARD ORDERED that decision on this matter is DEFERRED to May 12, 1992. IT IS FURTHER ORDERED that the Director of Building Inspection is REQUESTED to investigate if the Department at the time of the issuance of the permits had any knowledge that the property was to be acquired through eminent domain proceedings by the State of California and REPORT to the Board by May 12 , 1992. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes Of the Board of Supervisors on the date shown.
