Adopt the attached resolution which establishes a North Richmond Municipal Advisory Council. 2. Authorize an immediate recruitment of council members for the interim North Richmond Municipal Advisory Council representing a cross section of neighborhoods with two ( 2) seats designated for members from the incorporated portion of the North Richmond community. The council membership should, to the degree possible, cover representation from the following segments of the community: Black, Asian, Latino, youth, senior citizen, business community, homeowners ' association, Neighborhood House, Housing Authority, incorporated community. 3 . Authorize and direct the County Clerk (Elections Clerk) to take all steps necessary to place an item on the November 1993 general election ballot to elect permanent members to a North Richmond Municipal Advisory Council. 4 . Authorize the North Richmond Municipal Advisory Council to assume duties of any special task forces or area wide citizen public committee. 5. Direct the Director of GMEDA and County Administrator to begin the process of establishing a North Richmond Municipal Advisory Council so that it can be directed to officially begin its work by July 1992 . Mi.chel.le Washington, Neighborhood House of North Richmond, spoke on what has been accomplished in such a short time and suggested_ a reevaluation of the continu- ing ro.l.e of the Sheriff's Department in this area; she recommended that the County proceed with the Phase II portion of the improvement program for North Richmond. Following discussion, the Board then approved the recommendation as set forth above including the adoption of Reso.l.uti.on No. 92/306 providing for the creation of the North Richmond Municipal Advisory Council.. CC: (See next page for distribution) ATTESTED May 5, 1992 PHIL BATCHELOR,CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR BY DEPUTY s82 (10/88) -2- BACKGROUND On January 16 , 1992, the Board of Supervisors approved a series of recommendations involving the North Richmond community, one of which referred the issue of the possible establishment of a municipal advisory council (MAC) to the Director of the Growth Management and Economic Development Agency and County Administrator. Staff has found substantial community support for a North Richmond Municipal Advisory Council. At a community meeting on Saturday, April 25, 1992, citizens indicated their support for the establishment of a municipal advisory council. To address the issues expressed by residents, a MAC in North Richmond acts as a coordination point between North Richmond residents and the city and county governments. The MAC' s primary responsibilities in North Richmond should include the following: ♦ The North Richmond MAC should be the center in the neighborhood to receive any information pertaining to North Richmond about plans, projects, or actions in the city or county that will affect the neighborhood. ♦ The North Richmond MAC should be the central organizational structure by which residents can voice concerns, raise issues, or level complaints to the city and county agencies or officials who are serving North Richmond residents. ♦ The MAC would hold city and county governments accountable to serve residents, respond to complaints, and include residents' decisions. ♦ The North Richmond MAC should be the coordination point for any special task forces, or area wide citizen public committees. Citizens serving on the committees or task forces would report back to the MAC about decisions, events, or policies affecting the neighborhood. These citizens would be able to get support, feedback and guidance from the MAC members when working on committees. Orig. Creation of North Richmond Municipal Advisory Council Pursuant to the authority granted by Section 31010 of the California Government Code, the North Richmond Municipal Advisory Council (NRMAC) is hereby created . 2 . Membership The Council (both interim and permanent) shall consist of eleven ( 11 ) members , who shall be resident voters of the North Richmond community. The boundaries of the North Richmond community as depicted by the document and map references on file in the Contra Costa County Assessor' s Office for this purpose and which may be examined at that office . 3 . Terms of Office a . Appointed Interim Council . Interim Council members shall be appointed by the Board of Supervisors and their terms shall extend until their successors are elected and take office but in no event shall the terms of Interim Council members extend after noon on the first Friday of December 1993 . b. Elected Permanent Council . ( 1 ) The eleven permanent members of the NRMAC shall be elected by the resident voters of the NRMAC area in conformance with the Uniform District Election Law ( Elections Code sections 23500 et seq. ) , with the cost of conducting such election(s ) to be borne as directed by the Board of Supervisors . ( 2 ) The initial election for permanent Council members shall be held to coincide with the November 1993 regular election. Permanent Council members elected at the initial NRMAC 1993 election shall meet as soon as practicable after taking office and classify themselves by lot into two classes , as nearly equal in number as possible, and the terms of office of the class having the greater number shall be four years and the terms of office of the class having the lesser number shall be two years . Thereafter, all members elected at subsequent regular elections shall hold office for terms of four years or until their successors are elected and qualify (take office ) . C . Vacancy. Should a vacancy occur at any time in any Council member' s term, the Board of Supervisors may appoint a NRMAC community resident voter to serve for the remainder of that vacant office's term. " 4 . Council Duties and Powers The Council shall advise the Board on: a . Services which are or may be provided to the North Richmond community by the County or other local governmental agencies . Such 5-5-92 services include, but are not limited to, public health, safety, welfare, public works and planning. b. The feasibility of organizing the existing special districts serving the North Richmond community in order to more efficiently provide public services such as , but not limited to, water, sewer, fire, parks recreation, and infrastructure improvements . The Council may: a. Represent the North Richmond community before the Local Agency Formation Commission on proposed boundary changes affecting the community. b. Represent the North Richmond community before the County Planning Commission(s ) and the Zoning Administrator on land use and other planning matters affecting the community. In this regard, the Council shall cooperate with other planning advisory bodies in the North Richmond County area in order to avoid duplication and delay in the planning process . C . Provide input and reports to the Board, County staff or any County hearing body on issues of concern to the North Richmond community. It is understood that the Board is the final decision-making authority with respect to issues concerning the North Richmond community and that the Council shall serve solely in an advisory capacity. Except as specified above, the Council may not represent the North Richmond community to any State, County, city, special district or school district, agency or commission, or any other organization on any matter concerning the community. 5 . Compensation The Council members shall serve without compensation of any kind and the Board shall not provide funds for the payment of Council meeting stipends of reimbursement of Council members ' expenses . 6 . Staff and Financial Support The Board shall provide no ongoing professional or clerical staff support to the Council or provide funds to pay for any of the Council ' s operating costs . However, County staff will provide the Council with information and reports on matters of interest to the Council . 7 . Council Establishment Not Subiect to Vote The issue of establishment of an elected Council shall not be an election item submitted to the voters of the North Richmond community. 8 . Council Operation Within the parameters of this Resolution, the Council may organize itself and operate as it determines but shall hold regular meetings at least monthly at an established time and place. The Council meeting shall be conducted in accordance with the provisions of the "Brown Act" (Government code Sections 54950 ff . ) including the pre-meeting posting of meeting calendar notices . In addition, the Council shall fully comply with the Board of Supervisors ' policy concerning conflict of interest and open meetings (Resolution No. 82/574 and the Political Reform Act (Government Code Sections 81000 ff . ) as applicable. 9 . Council Funds Any funds transferred to or received by the County for the Council shall be accepted pursuant to Resolution No. 90/334 and only used for the benefit of the Council and its North Richmond community.
