HomeMy WebLinkAboutMINUTES - 05051992 - 1.11 THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on May 5,1992, by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson and McPeak NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 92/295 Government Code § 25526.6 SUBJECT: Conveyance of Easement to Pacific Gas & Electric Company Contra Costa County Byron Airport Project No. 4861-6X5329 Byron Area The Board of Supervisors of Contra Costa County RESOLVES THAT: Contra Costa County has acquired real property in the Byron area for the Contra Costa County Byron Airport. The Pacific Gas and Electric Company has requested an easement over a portion of said property, described in Exhibit "A" attached hereto, for pipeline purposes. This Board FINDS that the conveyance of such easement is in the public interest and will not substantially conflict or interfere with the County's use of the property. This Board hereby APPROVES and AUTHORIZES the conveyance of an easement to the Pacific Gas and Electric Company, over the property described in Exhibit "A" attached hereto, pursuant to Government Code Section 25526.6 and the Board Chair is hereby AUTHORIZED to execute said easement on behalf of the County in consider- ation for payment in the amount of $33,000.00. The Real Property Division is DIRECTED to cause said pipeline easement to be delivered to the grantee. Dept.: Public Works (R/P) ATTESTED: MAY5 --- 1992 cc: Public Works Accounting PHIL BATCHELOR,Clerk of the Board Public Works Records of Supervisors and County Administrator Grantee (via R/P) By e^� aA _ veputy Recorder (via R/P) RF:glo c:br27pg&e.t4 April 17, 1992 RESOLUTION NO. 92/ 295 1 -W Esm't to PG&E Byron Airport Exhibit "A" A non-exclusive easement for pipeline purposes lying within County's lands which are situate in the County of Contra Costa, State of California, and are described as follows: (APN 001-031-013, -014, -016) The southwest quarter of Section 23, and the north half of Section 26, all in Township 1 South, Range 3 East, M.D.B.&M.; excepting (a) from the southwest quarter of said Section 23 the two parcels of land, one described in the deed from Ida Helena Bruns to Contra Costa County dated June 22, 1912 and recorded in Volume 181 of Deeds at page 560, Contra Costa County Records, and the other described and designated PARCEL FIVE in the deed from Telio Morchio to James W. Hannum, as trustee, dated June 4, 1959 and recorded in Book 3428 of Official Records at page 374, Contra Costa County Records, and (b) from the northeast quarter of said Section 26 the parcel of land described in the deed from Frederick H. Bruns to the State of California dated September 24, 1963 and recorded in Book 4595 of Official Records at page 305, Contra Costa County Records. The aforesaid easement area is described as follows: A strip of land of the uniform width of 50 feet extending from the southerly boundary line of the parcel of land described in said deed dated June 22, 1912 southerly to the southerly boundary line of the northeast quarter of said Section 26 and lying 25 feet on each side of the line described as follows: Beginning at a point in the southerly boundary line of the parcel of land described in said deed dated June 22, 1912 and running along a line which is parallel with and 25 feet westerly of (measured at a right angle to) the easterly boundary line of the southwest quarter of said Section 23 (1) south 0° 11' 47" east 50 feet, more or less, to a point which bears south 43° 44' 51" east 3811.71 feet distant from the found 1-1/2 inch iron pipe with brass pin accepted as marking the northwest corner of said Section 23; thence continuing (2) south 0° 11' 47" east 2542.60 feet to a point in the southerly boundary line of said Section 23 which bears north 89° 56' 08" east 2634.98 feet from the found RR Spike accepted as marking the southwest corner of said Section 23; thence running along a line which is parallel with and 25 feet westerly of (measured at a right angle to) the easterly boundary line of the northwest quarter of said Section 26 (3) south 0° 04' 02" east 819.54 feet; thence leaving said parallel line (4 south 27° 50' 39" east 764.55 feet; thence 5 south 5° 46' 37" east 695.68 feet; thence (6 south 36° 47' 55" east 555 feet, more or less, to a point in the southerly boundary line of the northeast quarter of said Section 26; excepting therefrom the portion thereof lying within the boundary lines of said parcel of land designated PARCEL FIVE.
