Spooner, Contracts Administrator Costa DATE: May 1, 1992 COUtl/ SUBJECT: Approval of Contract Cancellation Agreement #24-545-4 with Bay Area Addiction Research & Treatment, Inc. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Chair to execute, on behalf of the County, Contract Cancellation Agreement #24-545-4, a mutual consent cancellation to cancel Novation Contract #24-545-2 (as amended by Contract Amendment Agreement #24-545- 3) with Bay Area Addiction Research & Treatment, Inc. , effective March 31, 1992. II. FINANCIAL IMPACT: None. The remaining funds encumbered under this Contract which was funded by Federal IV Drug Abuse Funds (Fed. Cat. #93.992) will be transferred to Contract #24-469-6 with Bay Area Addiction Research and Treatment, Inc. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: Bay Area Addiction Research and Treatment, Inc. has been providing methadone maintenance services for the County since 1988 under various Federal/State project grants such as the Federal Waiting List Project, the Federal Waiting Period Project, the AIDS HIV Counselor Project, and this Contract #24-545 which was funded by the IV Drug Abuse Project Grant,. Under the terms of this Project, the Contractor has been providing services for drug-abusing pregnant women, drug- abusing AIDS/ARC diagnosed persons, and other medically fragile clients who need not only methadone clinic services, but also primary care services. Because a larger number of these clients may receive quality primary care at a lower cost under Federal Medi-Cal, the Contractor and the Department wish to terminate Novation Contract #24-545-2 (as amended by Contract Amendment Agreement #24-545-3) , and shift the remaining funds to the Contractor's Contract #24-469. The Department anticipates that Contract Amendment Agreement #24-469-7 to increase the payment limit of Novation Contract #24-459-6 .will be approved by your Board on April 21, 1992. Therefore, in accordance with the Paragraph 5. (Termination) of the General Conditions, which specifies that Contract #24-545-2 (as amended) may be cancelled immediately by written mutual consent, the Department and the Contractor have agreed to a mutual cancellation of this Contract, and approval of Contract Cancellation Agreement #24-545-4 will accomplish this termination.
