Rainey, Sheriff-Coroner `3 Costa DATE: May 6, 1992 `OrT,�. �i J~ County SUBJECT: Agreement for Sheriff's Department-PCR-DNA Analysis System SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I . Recommended Action Approve and authorize the County Administrator or his designee to execute on behalf of the County the Polymerase Chain Reaction-Deoxyribonucleic Acid (PCR-DNA) Agreement, dated May 1, 1992 with certain Cities and Districts indicated below. II . Financial Impact The cost for the PCR-DNA system will be $72,270 for the first year and the cost for the second year is estimated to be. about $22,912 . This system will be funded by the Law Enforcement Agencies named below. The payments required by each Law Enforcement Agency are based on the County' s costs in establishing and operating the System and will be determined on the basis of each Law Enforcement Agency' s percentage of the population of Contra Costa County. Each agency will pay an amount in proportion to their population percentage of the total population of Contra Costa County. Contributions for Bay Area Rapid Transit (BART) Police and East Bay Regional Parks (EBRP) Police will be calculated using 1/3 of the daily use populations . This is identical to the Automated Fingerprint Identification Program (CAL-ID) method of allocation. First year costs are already available through savings in the CAL-ID Program. No additional County funds are required. PCR-DNA Agreement (continued) - 2 - 'May 6, 1992 Since the population of the unincorporated area of Contra Costa County is about 18 . 33%, $13,244 will be the Sheriff Department ' s contribution for the first year. This includes remodeling and equipment costs . The second year costs for the Sheriff 's Department will be about $4202 . III . Background: Introduction A Contra Costa County PCR-DNA Identification System is being created to make DNA testing of evidence in criminal cases available to law enforcement agencies within the County. PCR-DNA analysis offers. an advantage over conventional means of testing body fluids because it is more discriminating. This type of evidence is often critical in the investigation and prosecution of major crimes such as homicides and sexual assaults . By entering into a contract with the County, PCR- DNA testing will be made available to all Law Enforcement Agencies at a much lower cost than could be obtained from a private laboratory. DNA analysis is an exciting new technology currently making its way into crime laboratories across the United States . It has gained. acceptance and is being used more and more frequently in the Courts . DNA has greatly increased the capability of distinguishing individuals through the analysis of body fluids and tissues . Indeed, DNA analysis has proved so helpful, both to the prosecution and the defense, that more and more courts are insisting that it be done. DNA Technology There are two methods of DNA analysis currently in use in criminal investigations - RFLP and PCR. This Agreement, establishing a County-wide PCR-DNA analysis system was unanimously endorsed by the Contra Costa County Police Chiefs Association at their March 25, 1992 meeting. Members of the Chiefs Association understand that they will still have to budget for having the RFLP method of DNA analysis performed by private. laboratories . IV. Parties to the Agreement This agreement is between Contra Costa County and the following cities and districts: Antioch, BART, Brentwood, Clayton, Concord, Danville, East Bay Regional Parks, E1 Cerrito, Hercules, Kensington, Lafayette, Martinez, Moraga, Orinda, Pinole, Pittsburg, Pleasant Hill, Richmond, San Pablo, San Ramon, and Walnut Creek.
