ADOPTED this order on May 12 , 1992 by the following vote:

RESOLUTION NO. 92/310

Exchange for Corporation Yard )

WHEREAS, Section 99 of the Revenue and Taxation code .provides that in
the event `of a jurisdictional change that would affect the service area or
service ;responsibility of one or more special districts, the Board of
Supervisors shall, on behalf of the district or districts, negotiate any
exchange of property tax revenues; and
WHEREAS, the Corporation Yard Boundary Reorganization involves the
annexation of territory to the East Bay Municipal Utility District (EBMUD)
and the concurrent detachment of said territory from the Contra Costa Water
District (CCWD) which will affect the service responsibilities of the
Districts;
NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA
COSTA COUNTY DOES HEREBY DETERMINE that 100 percent of the property tax
revenue accruing to CCWD from the affected territory of the Corporation Yard
Boundary Reorganization shall be transferred to EBMUD. The terms of this
property tax exchange agreement shall be effective for the fiscal year for
which the State Board of Equalization makes the tax rate area changes for
this jurisdictional change and shall apply in subsequent years unless changed
by the mutual agreement of affected agencies or subsequent jurisdictional
changes. This resolution does not change the property tax revenues accruing
to other agencies servicing the subject territory or the affected agencies
right to collect taxes for existing bonded indebtedness. . The property tax
exchange agreement discussed above shall apply to affected territory as
submitted or revised by the Local Agency Formation Commission.
