MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: MAY 12, 1992 SUBJECT: STATE HIGHWAY 4/13AILEY ROAD INTERCHANGE Project No.: 4660-6X4158 Task: ACQ Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE the Relocation Assistance Claim from Louis and Mercedes Carrasco for their purchase differential entitlement in the amount of $18,500.00. B. AUTHORIZE Principal Real Property Agent to sign claim form on behalf of the County. C. AUTHORIZE the Auditor-Controller to issue a check in the amount of $18,500.00 to: Founders Title Company, 659 Main Street, Martinez, CA, 94553, Escrow No. 146476-MA. To be forwarded to the Real Property Division for delivery. I II. Financial Impact: Payment totalling $18,500.00 to be made from the State Highway 4/13ailey Road Interchange Project Fund which is 100% reimbursable from the Contra Costa Transportation Authority. III. Reasons for Recommendations and Background: Louis & Mercedes Carrasco reside at 521 So. Broadway, W. Pittsburg, a dwelling from which they are being displaced because of the interchange project. The purchase differential payment is part of their relocation entitlement required by Government Code § 7260, et seq. IV. Consequences of Negative Action: County would, not be in compliance with state and federal law. Recommended Action: A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated May 6, 1992 from Mercedes and Louis Carrasco. B. AUTHORIZE Public Works,Director to execute said Right of Way Contract on behalf of the County. C. APPROVE payment of$106,000.00 for said property rights and AUTHORIZE the Auditor- Controller to issue a check in said amount payable to Founders Title Company, 659 Main Street, Martinez, CA 94553, Escrow No. 127938-MA to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the office of the County Recorder. II. Financial Impact: Payment of $106,000.00 from State Highway 4/Bailey Road Interchange funds which are 100% reimbursable from Contra Costa Transportation Authority. III. Reasons for Recommendations and Background: These property rights are required for the State Highway 4/Bailey Road Interchange project in accordance with the approved plans and specifications. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
