SUBJECT PROPERTY IS LOCATED IN THE OAKLEY AREA. APPLICATION FILED BY BELLECCI AND ASSOCIATES AND NORTH STATE DEVELOPMENT COMPANY. SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation prepared for this project as being adequate. 2 . Approve Rezoning Application 2915-RZ, D.P. 3037789 and Subdivision 7426 subject to the conditions of the East County Regional Planning Commission (Exhibit A-attached) . 3 . Adopt the East County Regional Planning Commission's findings as set forth in Resolution No. 8-1992 as the determination for these actions. 4 . Introduce the ordinance giving effect to the aforesaid rezoning, waive reading and set forth date for adoption of same. BACKGROUND/REASONS FOR RECOMMENDATIONS On January 13 , 1992 , the East County Regional Planning Commission, after taking testimony, recommended that the Board of Supervisors approve this project for 26 lots and single family residences. Orig: Community Development Department ATTESTED .Apr;1 7_ 1 qq? cc: Bellecci & Associates PHIL BATCHELOR, CLERK OF North State Development Company THE BOARD OF SUPERVISORS Public Works-Mitch Avalon AD COU Y ADMINISTRATOR BY , DEPUTY Wi M ADDENDUM TO ITEM H.6 APRIL 7, 1992 This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request by Bellecci & Associates (applicant) and North State Development Company(owner) (2915-RZ) to rezone 5.7 acres of land from Agricultural District(A-2) for 27 lots to Planned Unit Development District (P-1) for 27 units, and for approval of a final development plan(3037-89) for 27 lots, and for approval to subdivide approximately 5.7 acres into 27 lots(Subdivision 7426) in the Oakley area. Dennis Barry, Community Development Department, presented the staff report on the matter, describing the location, and spoke of the recommendation of the Planning Commission for 26 lots and on the revised map submitted by the applicant, and he commented on the staff recommendations before the Board for consideration. Mr. Barry outlined the recommended modification that the 27 units be restored with the modified map supplied by the applicant and in Condition Ia, the date of the vesting tentative map received would be April 6, 1992, and in item 4a, there is a provision that lot number 5 shall have a side entry garage, that that condition be deleted. The public hearing was opened and the following persons spoke: Dennis Paterson, North State Development, expressed concurrence with the staff report; Bill Arrow, 213 Dennis Court, Oakley, questioned the lot and home size, and traffic flow. The public hearing was closed. Supervisor Torlakson moved approval of the staff recommendation and with additional language that alternatively to the normal park dedication, if something can be worked out in terms of in lieu to get improvement for the neighborhood with flexibility. Supervisor Fanden seconded the motion. IT IS BY THE BOARD ORDERED that recommendations 1, 2 with amended conditions, 3 and 4 are APPROVED; and Ordinance No. 92-23, giving effect to the rezoning is INTRODUCED, reading waived and April 14, 1992, is set for the adoption of same.
