NOW, THEREFORE, BE IT RESOLVED that the District Attorney of the County of Contra Costa is authorized, on its behalf to submit the attached proposal to OCJP and is authorized to execute on behalf of the Board of Supervisors the attached Grant Award Agreement, including any extensions or amendments thereof. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions or damages, shall be the responsibility of the grant recipient and the authorized agency. The State of California and OCJP disclaim responsibility for any such liability. YANCEY, District Attorney Costa County DATE: March 26, 1992 rT,a-d" SUBJECT: Approval for Submission and Execution of Contract with the State Office of Criminal Justice Planning for the funding of the Contra Costa Child Abuser Vertical Prosecution Program: 7/1/92 -- 6/30/93 SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION Authorize the District Attorney to submit an application and execute a grant award contract with the State Office of Criminal Justice Planning for funding of the Contra Costa Child Abuser Vertical Prosecution Program for the period 1 July 1992 to 30 June 1993, in the amount of $122,500. (State funds) FINANCIAL IMPACT The grant application is in the amount of $122,500 to fund salaries and benefits for an attorney and a clerk for the project. No county match is required. This year, the State Office of Criminal Justice planning has announced .statewide competition for funds which will be made available each year for 3 years. Since this is a competitive grant there is no assurance that contra Costa County will receive this award. If the project is funded, appropriation and revenue adjustments, as well as P-300's, will be submitted for Board action. REASONS FOR RECOMMENDATION The goal of the State program is to enhance prosecution of Child Abusers through vertical prosecution, thereby increasing the likelihood of convicting offenders and ensuring appropriate sentences for their crimes. California Penal Code section 999q .through .999y authorizes .the State program and sets forth its guidelines. While the statewide statistics show the incidence of reported child abuse cases have leveled off and slightly declined over the last three years, local statistics reveal that the number of Sexual Assault cases filed in Contra Costa County have increased from 204 in 1988 to 351 in 1991. Since we have no state funding for prosecution of sexual assault related cases, the number of attorneys specializing in this area have decreased from 6 in 1986 to 5 as of this date. This funding would enable us to more effectively seri the most vulnerable and deserving of crime victims. The present caseload of 30 cases per attorney is excessive for this type of case. The approval of this application will permit the District Attorney to seek funds which will allow a caseload reduction to 15-18 cases for the Attorney handling the most serious cases of sexual child abuse, and allow for a substantial enhancement of service to the children of Contra Costa County.
