SUBJECT: GRANT DEED OF EASEMENT
I. RECOMMENDED ACTION:
ADOPT Resolution No. 3635 authorizing the Executive Director of the Housing
Authority of the County of Contra Costa to execute a Grant Deed of Easement to
Pacific Gas and Electric for land use rights where underground facility improvements
will be installed at CA011004, Los Nogales, Brentwood.
II. FINANCIAL IMPACT:
The Housing Authority's cost for the construction, installation, inspection,
maintenance, replacement, removal and use of underground facilities to convert
utilities at Los Nogales, CA011004, Brentwood, has been set aside in the
Comprehensive Improvement Assistance Program budget CA011-912.
III. REASONS FOR RECOMMENDATION/BACKGROUND:
On April 24, 1990 under Resolution No. 3579, the Board of Commissioners
approved the 1990 Comprehensive Improvement Assistance Program application which
included replacement of the overhead electrical distribution system by an underground
electrical distribution system, and a more efficient site lighting system throught
the development CA011004, Los Nogales, Brentwood. This system was to be designed and
installed by PG&E.
PG&E now is prepared to install the underground electric facilities at
Brentwood. Before work can be started, it will be necessary for,the Housing
Authority of the County of Contra Costa to provide a grant of easement for the
installation of the facilities at CA011004, Los Nogales, Brentwood.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect to not adopt Resolution No. 3635
authorizing a grant deed of easement to Pacific Gas & Electric Company for land use
rights where underground facility improvements will be installed at the Housing
Authority's development in Brentwood, the Housing Authority could be forced to
forfeit the funds allocated by HUD for this project. Additionally, the Board of
Commissioners would be adopting a posture contrary to its position of providing
decent, safe and sanitary housing for low and moderate income families in Contra
Costa County.

AUTHORIZING EXECUTION OF GRANT OF EASEMENT
TO PACIFIC GAS AND ELECTRIC COMPANY FOR UNDERGROUND FACILITIES
CA011004, BRENTWOOD
WHEREAS the Board of Commissioners of the Housing Authority of the County
of Contra Costa under its 1990 Comprehensive Improvement
Assistance Funding Program, in its continuing effort to provide
decent, safe and sanitary housing, elected to upgrade the utilities
at its Brentwood project, CA011004; and,
WHEREAS, Pacific Gas and Electric Company, a California Corporation, proposes
to construct, install , inspect, maintain, replace, remove and use
underground facilities to convert utilities at CA011004, Brentwood;
and,
WHEREAS, in order to proceed with conversion of overhead facilities to
underground facilities a Grant of Easement from the Housing
Authority of the County of Contra Costa to Pacific Gas and
Electric is required:
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the
Housing Authority of the County of Contra Costa authorizes the
execution of a Grant of Easement to Pacific Gas and Electric
Company on the land rights where the underground facility
improvement project is to be installed, as shown on Exhibit A
attached hereto and made a part hereof.
This Resolution is to become effective immediately upon receipt of
HUD approval .
PASSED ON April 7, 1992 by the following vote of the Commissioners:
AYES: Commissioners Powers, Fanden, Torlakson, McPeak
NOES: None
ABSENT: Commissioner Schroder
