COt1t!"d - Di-strict Attorney Costa DATE: April 16, 1992 CN rt, SUBJECT: Authorization For the Participation of the Contra Costa County District Attorney's Office in the City of Richmond's Gang Violence Suppression Program Grant Application to the Office of Criminal Justice Planning SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMENDED ACTION Authorize the District Attorney's Office to participate in the City of Richmond's Gang Violence Suppression Program (GVSP) grant application proposal to the Office of Criminal Justice Planning (OCJP) for a one to three year period. The entire grant application seeks one to three years of funding of $500,000 per year for a three year total of $1.5 million. The components of the program include prosecution, probation, law enforcement, education, and prevention. FINANCIAL IWACT The grant application is in the amount of $1.5 million. Should the award be granted, the City of Richmond would execute_ the appropriate agreements to designate up to $100,00 per year, or $300,000 for three years, to the District Attorney's Office for the provision of one (1) full-time staff investigator and/or deputy district attorney per year of the grant ward. No County match is required. Since this is a competitive grant., there is no assurance that the City of Richmond and Contra Costa County will receive this award. If the project is funded, appropriation and revenue adjustments, as well as P-3001s, will be submitted for Board action. REASONS FOR RECOMMENDATION The goal of the GVSP is to help identify and eradicate gang activity in targeted areas of Richmond and San Pablo. The role' of the District Attorney's Office is to enhance prosecution of gang members through vertical prosecution, thereby increasing the likelihood of convicting offenders and ensuring appropriate sentences for their crimes. California Penal Code section 999q through 999y authorizes the state program and sets forth is guidelines. As the activities of .gang members in Richmond and other areas of Contra Costa County have risen, so have the negative socio-economic effects on the local citizens and public enforcement agencies. Since the County has no state funding for vertical prosecution of gang-related cases, this funding would enable the County and affected jurisdictions to more effective prosecute alleged gang members. NOW, THEREFORE, be it resolved that the District Attorney's Office of the County of Contra Costa is authorized, on its behalf, to participate in the attached grant application proposal to - be submitted by the City of Richmond to OCJP, and is authorized to provide information as may be required to compete for the grant award. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions or damages, shall be the responsibility of the grant recipient and the authorized agency. The State of California and OCJP disclaim responsibility for such liability. BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to supplant expenditures controlled by this body.
