SUBJECT: AMENDMENT 2 TO LAND USE PERMIT 2122-86 FOR THE ACME FILL WASTE RECOVERY
AND TRANSFER STATION
SPECIFIC REQUEST(S) OR RECOMMENDATION(8) S BACKGROUND AND JUSTIFICATION
.RECOMMENDATIONS
1. Affirm that the, Board of Supervisors has reviewed and
considered the Final Environmental Impact Report (December
1987) and Addendum 3 (March 1992) before acting on this item.
2. Certify that Addendum 3 has been completed in compliance with
the California Environmental Quality Act.
3. Approve Amendment 2 to Land Use Permit 2122-86.

BACKGROUNDfREASONS FOR RECOMMENDATIONS
The County Planning Commission and staff recommend approval of
Amendment 2 (see Planning Commission Resolution and March 31, 1992
staff report) .
The applicant, Acme Fill Corporation, requests that Land Use Permit
2122-86 be amended to extend the closing date of its Interim
Transfer Station at the Acme Landfill from July 27, 1992, to
December 31, 1993. Continued use of the Interim Transfer Station
is necessary to ensure that waste be processed through ,a transfer
station as required for export to other counties, includ�rK( Volano
County, and to in-county landfills, including Keller Canyon and
Marsh Canyon landfills: This latter requirement is a Condition of
Approval for the -two new landfills.
Construction of the Permanent Transfer Station, which would replace
the Interim Station, has met with several delays. Some of these
delays have been due to the additional time needed for the design
of the facility, as well as for the design review by permitting
agencies. The uncertainty created by the negotiations involving
the County and Central Contra Costa Sanitary District to purchase
the transfer station project, and the related issue of obtaining a
committed wastestream have also resulted in on-going delays.
Acme estimates that the permanent station will be operational by
October 31, 1993. The extension date of December 31, 1993, was
chosen to coincide with the Bay Area Air Quality Management
District's decision to extend Acme's permit and Authority to
Construct for the permanent station facility to the December date.
The 60-day overlap will also provide a cushion in the event of any
problems during start-up of the permanent station.
The Board certified the Acme Fill Waste Recovery and Transfer
Station EIR on December 15, 1987. Since the proposed change is not
a substantive modification, i.e. it does not change the physical
characteristics of the project itself nor the nature or extent of
its impacts on its setting, staff regards the change as being
consistent with the project covered in the EIR. An addendum to the
EIR, therefore, has been prepared according to Section 15164 of the
California Environmental Quality Act Guidelines.

This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the Amendment 2 to Land Use Permit 2122-86
for the Acme Fill Waste Recovery and Transfer Station.
The public hearing was opened and no one appearing to speak, the
public hearing was closed.
As recommended by Supervisor Fanden, recommendations 1, 2, and 3
are APPROVED.
As requested by Supervisor Powers, staff is to prepare a report
for Board consideration on April 28, 1992 on the actual remaining
capacity of the Acme Landfill site and how long it will continue to be
utilized.
