Sutter; Approve Purchase Contract and accept Grant Deed from John H. Sutter and authorize the Redevelopment Director or his Designee to execute said agreement on behalf of the Agency; and Approve an estimated revenue adjustment and appropriation adjustment for $445, 000. FISCAL IMPACT The Contract provides for the Agency to acquire the above referenced property and settle a claim .for damages for an all-inclusive price of $445, 000. The Agency will be receiving an advance from funds other than Fund 111300 to cover these costs. BACKGROUND/REASONS FOR RECOMMENDATIONS The subject property is part of development Area 4 in the Pleasant Hill BART Station Area. This development area was originally to be developed by a partnership of Glenfed Development Corp. and Desco Investment. That partnership was unable to perform and will not be pursuing development on this site. Because of the developers inability to perform, Mr. Sutter filed a . claim for damages. The Settlement Agreement, and the consideration provided therein, dismisses all claims.
