DATE: April 14, 1992 Py'"``y' � `c County <ounT' SUBJECT: WEST COUNTY JUSTICE CENTER EXTENDED CONSULTANT CONTRACT ADMINISTRATION (DWORSKY/DESIGN PARTNERSHIP AND O'BRIEN-KREITZBERG) Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION: APPROVE additional contract administration services resulting from an extended construction period and AUTHORIZE the Director, Justice System Programs, to order architect and engineering services from Dworsky/Design Partnership in accordance with Article IV.G of their agreement and project management services from O'Brien-Kreitzberg and Associates (contract amendment) . FINANCIAL IMPACT: The cost for these extra professional services shall be based on actual cost not to exceed $38,500 for Dworsky/Design Partnership and $58,000 for O'Brien-Kreitzberg and Associates. Funds for these additional services are budgeted and available. REASONS FOR RECOMMENDATION/BACKGROUND: The West County Justice Center project was made possible by a grant from the California Board of Corrections (Proposition 16) for approximately $36 million (75% of the project) . Design changes resulted in lower construction costs. As a result, the Project Manager was able to negotiate an agreement with the Board of Corrections which allowed the saved $2.3 million to be combined with a second Board of Corrections grant (Proposition 52 for approximately $2.6 million) to be used for expansion and remodeling work at the County's Marsh Creek and Martinez Detention Facilities. In addition, the State accepted the County's prior expenditure for a capital project at Marsh Creek to be used as the County's $2.4 million match. Overall, the County had a total of approximately $7 million for capital improvements for these two facilities. Following inmate occupancy in June 1991, the Architect and Project Manager continued to provide extended services in resolving contractor disputes and project closeout at the Martinez Detention Facility and in overseeing contractor re-work at the Marsh Creek Detention Facility resulting in discovered shower latent defects. The extended services for the Architect/Engineer covers the period from last April to the present. As part of a negotiated settlement for these extended services, the invoiced costs will be limited to 75% of the billing rates described in their Agreement with the County. The extended .services for the Project Manager covers the period from last July to the present. This fee includes all services provided at the West County, Marsh Creek and Martinez Detention Facilities. Both consultants have been advised that any costs. for extended services beyond these authorized limits will not be charged to the County. All construction contractsare now final. No claims were filed on any of these projects.
