MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: April 14, 1992 SUBJECT: Street Lights within Subdivision #7040 and #7041 (Shadow Creek).- Danville SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: Board of Supervisors to make an exception to County Street Lighting Policy; and Authorize the Public Works Director to notify the Pacific Gas and Electric Company, that the County will accept the monthly charges for street lights on non-County maintained roads within Subdivision #7040 and #7041 on behalf of County Service Area L-100. II. Financial Impact: Cost of operating street lights in Subdivision #7040 and #7041 will be paid for by County Service Area L-100. III. Reasons for Recommendations and Background: The curr$nt' County policy on street lighting (Resolution No. 72/341), adopted by the Board of Supervisors on May 23, 1972, requires that all street lights that are to be financed by a County Service.Area, shall only be on County maintained roads. Due to unusual problems (blue water, etc.) encountered by the developer and residents living in Subdivision 7040 and 7041, the County's normal acceptance of the roads for maintenance in these two subdivisions has been delayed. The developer paid a one year lighting deposit ($9329.00) for lights in both subdivisions in 1989. The parcels in both subdivision were added to the tax roles in 1990. This service charge would normally be used to pay the monthly bill for street lights that are energized in these two subdivisions. The roads within Subdivision #7040 and #7041 have not yet been accepted for maintenance by the County, and the developer has been paying the monthly cost to energize street lights. However, the developer discontinued paying for these lights in November, 1991. Pacific Gas & Electric Company has notified County staff that unless County Service Area L-100 accepts the monthly bill for these street lights, PG & E may turn off the lights. Due to the unusual circumstances, and in the best interest of the local residents, the Public Works Director requests the Board of Supervisors to make an exception to the "County maintained roads" requirement contained in the current lighting policy. It is anticipated that the roads within Subdivision 7040 and 7041 will be accepted by the County in the near future. IV. Consequences of Negative Action: Pacific Gas & Electric Company may turn off the street lights for non-payment thereby creating an undue hardship and potential safety problems for residents.
