HomeMy WebLinkAboutMINUTES - 04141992 - 1.12 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on April 14, 1992 by the following vote: AYES: Supervisors Fanden, Torlakson and McPeak NOES: None ABSENT: Supervisors Powers and Schroder ABSTAIN: None RESOLUTION NO. 92/226 SUBJECT: Approval of the Final Map and Subdivision Agreement for Improvement Warranty for Subdivision 7300, Martinez Area. The Public Works Director having notified this Board that the improvements for Subdivision 7300, being developed by Loretta W. Cziglenyi have been completed and that such improvements have been constructed without the need for a Subdivision Agreement; The following documents were presented for Board approval this date: The Final Map of Subdivision 7300, property located in the Martinez area, said map having been certified by the proper officials; A Subdivision Agreement for Improvement Warranty with Loretta W. Cziglenyi, subdivider, whereby said subdivider agrees to warrant all improvements for one year as required in said Subdivision Agreement for Improvement Warranty; Said documents were accompanied by: I. Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance.Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 204776, dated March 26, 1992) in the amount of $1,000 made by Loretta W. Cziglenyi. B. Additional security in the form of a cash deposit (Auditor's Deposit Permit No.204776, dated March 26, 1992) in the amount of $4,520 ($275 for faithful performance and $4,245 for labor and materials) made by Loretta W. Cziglenyi. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1991-92 tax lien has been paid in full and the 1992-93 tax lien, which became a lien on the first day of March, 1992, is estimated to be $1,900. III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a cash deposit (Auditor's Deposit Permit No. 204865, dated March 27, 1992) made by Loretta W. Cziglenyi in the amount of $1,900 guaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans; BE IT FURTHER RESOLVED that the improvementshave been COMPLETED as of March 25, 1992 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement; BE IT FURTHER RESOLVED that the$4,245 cash security for labor and materials (Auditor's Deposit Permit No. 204776, dated March 26, 1992) deposited by Loretta W. Cziglenyi be RETAINED for the six-month lien guarantee period until September 26, 1992, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file. P, !2 Approval Final Map - Sub 7300 April 14, 1992 Page Two BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement for Improvement Warranty is also APPROVED.
