BRAGDONcou rd'• ' "J DIRECTOR OF COMMUNITY DEVELOPMENT DATE: March 24, 1992 SUBJECT: Hearing on Rezoning Application 2956-RZ to rezone 2.5 acres from Agricultural District (A-2) to Planned Unit Development (P-1) and Development Plan 3019-91 to construct a Veterinary Hospital, in the Oakley area. SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the Environmental Documentation prepared for this project as being adequate. 2. Approve Rezoning Application #2956-RZ as recommended. by the East County Regional Planning Commission. 3. Approve Development Plan #3019-91 with amen ded ` condiitions, Exhibit A attached hereto and by reference incorporated herein as recommended by the East County Regional Planning Commission. 4 . Adopt the East County Regional Planning Commission's findings as set forth in its Resolution No. 12-1992 as the determination for this decision. 5. Introduce the ordinance giving effect., to the rezoning application #2956-RZ, waive reading and set for adoption of same. BACKGROUND/REASONS FOR RECOMMENDATIONS The background for this project is reviewed in the January 27; 1992 staff report to the East County Regional Planning Commission: The Commission reviewed the application on January 27, 1992 andtafter taking testimony, the East County Regional Planning Commission voted to approve Minor Subdivision 28-91 and recommend pproval to the Board of Supervisors approval of Rezoning 95 -R an Development Plan 3019-91. Orig: Community Development Department ATTESTED .�f�, cc: Bellecci & Associates PHIL BATCHELOR, CLERK OF Clifford & Scottie Munns, Jr. THE BOARD OF SUPERVISORS Public Works Department AND COUNTY ADMINISTRATOR DD/df BY DEPUTY ADDENDUM TO H.8 MARCH 24, 1992 The Chair convened the hearing on the recommendation of the East County Regional Planning Commission on the application (2956-RZ) of Bell and Associates (applicant) and Clifford Munns (owner) for approval to rezone 2.5 acres from Agricultural District (A-2) to Planned Unit Development (P-1) and Development Plan 3019-91 to construct a veterinary hospital, in the Oakley area. All persons desiring to speak were heard. Board members reviewed the recommendations of the Director of the Community Development Department set forth in the report attached hereto and by reference incorporated herein. Supervisor Torlakson spoke on the need to fund local trails that will eventually connect with the East Bay Regional master trail system. Further, he referred to the necessity to complete the trail master plan and determine the pro-rata system share (whether on a frontage basis or per unit basis), so that everybody contributes in some way to complete the trail system. Therefore, Supervisor Torlakson recommended that as an amendment to the conditions of approval for Development Plan 3019-91, that this applicant would participate on a fair share basis with other similarly situated property owners should such a program be instituted prior to the time that building permits were sought on the project. Board members being in agreement, IT IS BY THE BOARD ORDERED that the hearing is CLOSED and that the recommendation of Supervisor Torlakson is APPROVED. IT IS FURTHER ORDERED that the recommendations of the Director of Community Development are APPROVED, which include approval of rezoning application 2956-RZ, Final Development Plan No. 3019-91 as amended, and MS 28- 91, Oakley area. IT IS FURTHER ORDERED that Ordinance 92-22 is INTRODUCED, reading waived, and April 7, 1992, is FIXED as the time for adoption.
