SUBJECT: Rezoning - GINGER BUMGARDNER (2931-RZ) , requesting to rezone 2.75 acres
from M-17 to Planned Unit District (P-1) , (with Variance to the minimum
.area requirement (5 acres required) ;' Final Development Plan #3037-90
and Vesting Tentative Map #7624 - E1 Sobrante area. (S. D. I. )
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared ';' for his
.,
project as being complete and adequate.
2 . Approve rezoning application 2931-RZ, with variance,,,,'.-,t6 >the "
minimum requirement for parcel size and subject to:-Condition
of Approval recommended by. the County Planning Commission and
also approve Final Development Plan 3037-90 and Subdivision
#7624 subject to- Conditions- of Approval as recommended by the
County Planning Commission.
3 . Adopt the County Planning Commission's findings as set forth
in Resolution No. 11-1992 , as the determination for these
actions.
4 . Introduce the ordinance giving effect to the aforesaid
rezoning; waive reading and set date for adoption of same.

ADDENDUM TO ITEM H . 7
MARCH 24 , 1992
This is the time heretofore noticed by the Clerk of
the Board of Supervisors for hearing on the
recommendation of the Contra Costa County Planning
Commission on the request of Ginger Bumgardner
(applicant and owner) for approval to rezone 2 . 75 acres
of land from Multiple Family District (M-17 ) to Planned
Unit District ( P-1 ) (2931-RZ ) , for approval of a final
development plan ( 3037-90 ) for 32 units, and for
approval to subdivide approximately 2 . 75 acres of land
into 32 Town Home lots (Subdivision 7624 ) in the El
Sobrante area .
Dennis Barry, Community Development Department,
presented the staff report on the proposed project,
describing the site and the staff recommendations .
The public hearing was opened and the following
persons presented testimony:
Ginger Bumgardner, 1289 Macdonald Drive, Pinole;
Alan English, 12226 San Pablo Avenue, Richmond,
project architect;
George Schmidt, 5017 Sweetwood Drive, Richmond;
Ms . Bumgardner spoke in rebuttal .
Supervisor Powers moved approval of the project
with a modification to condition number 2 to suggest
saving the tree without jumping through hoops .
Supervisor Schroder suggested that if it becomes
necessary to save natural foilage to give consideration
to a variance in the development plan .
Supervisor Powers concurred.
IT IS BY THE BOARD ORDERED that recommendations 1 ,
2 with modifications to the conditions , 3, and 4 are
APPROVED; and Ordinance No . 92-21, giving effect to the
rezoning is INTRODUCED, reading waived, and April 7 ,
1992 is set for adoption of same .
