Awad Al-Khudari) Located in the E1 Sobrante Area (APN #425-061-005, -006, -007) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Deny the appeal of the neighbor, Mrs. Eakle, from the approval of Subdivision 7451 and deny the appeal of the applicant from the County Planning Commission's approval of this subdivision with 12 rather than 14 lots. Sustain the action of the County Planning Commission approval of Subdivision 7451 for 12 lots in accordance with Option A actions listed below. BOARD OPTIONS Option A: Sustain County Planning Commission Decision 1. Declare the Board of Supervisors' intent to: A. Deny the appeal of Mrs. Jan Eakle, a neighbor. B. Deny the appeal of the applicant, JED'CO Engineering for approval of 14 lots. C. Accept the environmental documentation for this project as being adequate. D. Approve Subdivision 7451 for 12 lots subject to the conditions of approval of the County Planning Commission (attached as Exhibit A) . 2 . Direct staff to develop appropriate findings. Option B: Reverse the County Planning Commission Decision . - Allow 14 lots 1. Declare the Board of Supervisors intent to: A. Deny the appeal of the neighbor, Mrs. Jan Eakle. B. Grant the appeal of the applicant and approve Subdivision 7451 with 14 lots as originally requested. Approve Subdivision 7451 with 14 lots subject conditions of approval attached as Exhibit A, except as amended by revised condition #1 as follows: . 111. This application is approved, generally, as shown on the revised Tentative Map dated received May 171' 1990, by the Community Development Department. Unless otherwise noted, the following conditions shall be complied with before filing the final map. At least 30 days prior to filing a final map or issuance of a grading permit, the subdivider shall submit a revised site plan for the review and approval of the Zoning Administrator, providing for the following changes: A. The boundary line between Lots #9 and #10 to be moved to coincide with .the creek setback line. B. Creek setback line to coincide with the north-south portion of the Lot 5-6 line. " 2 . Direct staff to develop appropriate findings. Option C: Uphold Board's Previous Decision to Deny Subdivision 7451 1. Deny appeal of the applicant, JEDCO Engineering. 2 . Grant the appeal of the neighbor, Mrs. Jan Eakle, and deny Subdivision 7451. 3 . Readopt previously adopted Board's findings for denial of project, attached as Exhibit B. BACKGROUND This application reached the Board of Supervisors on appeal of both the applicant and a neighboring property owner on June 6, 1991. After several hearings, the Board gave its intent to deny the application and directed staff to prepare findings. On October 22 , 1991 the Board adopted the findings and denied Subdivision #7451. Subsequently, the applicant requested Board reconsideration of the denial of Subdivision #7451. On December 17, 1991 the Board granted reconsideration hearing for Subdivision #7451. Additional submitted information and staff discussion is included as Exhibit C. ADDENDUM TO ITEM H. 6 MARCH 24, 1992 This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on reconsideration of the Board of Supervisors' decision for denial without prejudice of the application by JEDCO Engineers (applicant) and M. Awad A1-Kundari (owner) requesting approval of a tentative map (Subdivision 7451) to subdivide 4.58 acres into 14 lots, and granting the appeal of Mrs. Jan Eakle, et al, from the Contra Costa County Planning Commission approval for 12 lots in the E1 Sobrante area. Dennis Barry, Community Development Department, presented the staff report on the matter, describing the location of the property, and presented the various options for Board consideration. The public hearing was opened and the following persons presented testimony: Firas Jandali, 930 Dwight Way #10A, Berkeley, representing JEDCO Engineers; Bill Lepere, 20188 Wisteria Street, Castro Valley, representing JEDCO Engineers; Jan Eakle, 597 La Paloma, El Sobrante; Farhad Ghaemmaghami, 640 and 590 La Paloma Road, E1 Sobrante; George Schmidt, 5017 Sweetwood. Drive, Richmond; Bob Argo, 534 La Paloma Road, E1 Sobrante; Don Cook, 580 La Paloma Road, E1 Sobrante; B.J. Hicks, 1041 San Pablo Avenue, Albany; Brian Torbet, 554 La Paloma, El Sobrante; R.D. Red Riley, 4069 Granada Road, E1 Sobrante; The Board discussed the matter and Supervisor Powers advised that he would like an opportunity to meet with staff and explore the questions raised during testimony today on issues including sight distance, the stop sign and the way the road impacts the adjacent houses and driveways. Victor Westman, County Counsel, advised that the hearing should be left open and the matter continued. IT IS BY THE BOARD ORDERED that the hearing on the reconsideration of the application of JEDCO Engineers on Subdivision 7451 in the E1 Sobrante area is CONTINUED to April 7, 1992 , at 10:45 a.m. (Decision Calendar) .
