5 The Board of Supervisors of Contra Costa County,
6 California by vote of two-thirds or more of its members, RESOLVES
7 that:
8 Pursuant to Government Code section 25350 . 5 and Streets
9 and Highways Code section 943, Contra Costa County intends to
10 construct a road reconstruction project, a public improvement to
11 widen a portion of State Highway 4 in the Oakley area, and in
12 connection therewith, acquire interests in certain real property.
13 The property to be acquired consists of 10 parcels and
14 is generally located in the Oakley area . The said property is
15 more particularly described in Appendix "A" , attached hereto and
16 incorporated herein by reference. Some of the property sought to
17 be acquired is property appropriated to a public use; the
18 proposed use is a more necessary public use than the use to which
19 the property is now appropriated or a compatible public use
20 (C.C.P. §§ 1240 . 610, 1240 .510) .
21 On March 6 , 1992, notice of the County' s intention to
22 adopt a resolution of necessity for the acquisition by eminent
23 domain of the property described in Appendix "A" was sent to
24 persons whose names appear on the last equalized County
25 Assessment Roll as the owners of said property. The notice
26 specified March 24, 1992 at 11:00 a.m. in the Board of
27, Supervisors Chambers in the Administration Building, 651 Pine

1 Street, Martinez, California, as the time and place for the
2 hearing thereon.
3 The hearing was held on March 24, 1992, at that time and
4 place, and all interested parties were given an opportunity to be
5 heard and based upon the evidence presented to it, this Board
6 finds, determines and hereby declares the following:
7 1 . The public interest and necessity require the
8 proposed project; and
9 2 . The proposed project is planned and located in the
10 manner which will be most compatible with the greatest public
11 good and the least private injury; and
12 3 . The property described herein is necessary for the
13 proposed project; and
14 4 . The offer required by section 7267 . 2 of the
15 Government Code was made to the owner or owners of record.
16 The County' s counsel is hereby AUTHORIZED and EMPOWERED:
17 To acquire in the name of Contra Costa County, by
18 condemnation, the titles, easements and rights of way as set
19 forth in Appendix "A" , in and to said real property or interests
20 therein, in accordance with the provisions of eminent domain in
21 the Code of Civil Procedure and the Constitution of California.
22 All parcels are to be acquired in fee title.
23 To prepare and prosecute in the County' s name such
24 proceedings in the proper court as are necessary for such
25 acquisition.
26 To deposit the probable amount of compensation, based on
27 an appraisal, and to apply to said court for an order
28 permitting the County to take possession and use said real
