THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on March 24, 1992 by the following vote:
AYES: Supervisors Powers, Schroder, Torlakson and McPeak
NOES: Supervisor Fanden
ABSENT: None
ABSTAIN: None
SUBJECT: Decision on Appeals by Carole Baird, et al On LUP
2090-91 and Building Permit 170731, Bi-Bett Corporation
Clayton Area.
On March 17, 1992, the Board of Supervisors deferred to this date
the decision on the appeal of Carole Baird, et al from the decision of
the Contra Costa County Planning Commission on the application of
Bi-Bett Corporation (applicant and owner) for approval to establish an
approximately 5 ,402 square foot, 20 bed, drug and alcohol facility
(Land Use Permit 2090-91) , and the decision on the appeal of Carole
Baird, et al, on the issuance of Building Permit No. 170731 for
construction of a youth treatment facility at 11540 Marsh Creek Road
in the Clayton area.
Supervisor Torlakson requested clarification from County Counsel
and Community Development relative to the legal issues and process
having been properly addressed.
Victor Westman, County Counsel, referred to the memo to the Board
dated March 24, 1992 from County Counsel' s office addressing
Supervisor Torlakson' s concerns.
Dennis Barry, Community Development Department, commented that
there was no additional information.
Supervisor Torlakson commented on problems with the early portion
of the process including notification and communication, and he
advised that he would be joining with the recommendations of the staff
and the Planning Commission in favor of the Land Use Permit with the
addition of a condition relative to a management and monitoring
program and an annual evaluation component.
Mr. Barry suggested that the Board declare its intent today and
allow staff to bring back the proper findings and specific wording for
such a condition.
Supervisor Torlakson concurred with the suggestion and he moved
to adopt the staff recommendations and to amend the land use permit
approval regarding a management program for the project and he
requested that Bi-Bett meet and communicate with the neighbors at an
appropriate future time.
Supervisor Powers seconded the motion.
Supervisor Schroder inquired whether the motion included the
denial of the two appeals before the Board.
Supervisor Torlakson responded affirmatively.
IT IS BY THE BOARD. ORDERED that the Board of Supervisors DECLARES
ITS INTENT to adopt the Negative Declaration for the project, to
affirm the Planning Commission' s approval of Land Use Permit #2090-91
with amended conditions, to deny the appeal of Carole Baird, et al
from the decision of the Contra Costa County Planning Commission on
the application of Bi-Sett Corporation on Land Use Permit 2090-91, and
to deny the appeal of Carole Baird, et al on Building Permit No.
170731; 'and staff is DIRECTED to prepare the appropriate documentation
for Board consideration on April 14, 1992.
