SUBJECT: Reimbursement to Dam6 Construction Company for work performed on Camino
Tassajara in the Danville area. (Payment No. 3)

SPECIFIC REQUEST(S) OR RECOMMENDATIONS) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
1) Authorize the Public Works Director to arrange with the Auditor's Office to pay Dame
Construction Company reimbursement payment No. 3 in the amount of$58,971.91. This is for
work performed on Camino Tassajara in realigning the Bettencourt curve as identified on the
project list of the Joint Exercise of Powers Agreement between the Town of Danville, the City of
San Ramon and Contra Costa County.
2) Authorize the Public Works Director to arrange payment to Dame Construction Company for
the costs to construct frontage improvements for the Blackhawk Equestrian Center property
located on Camino Tassajara at Leema Drive. These costs are estimated at$29,806.52 and will
be reimbursed by the Blackhawk Equestrian Center pursuant to a deferred improvement
agreement with the County.
3) Authorize the Public Works Department to arrange for payment to Dame Construction
Company for the costs to remove an abandoned EBMUD waterline in Camino Tassajara. This
cost is estimated to be $8078 and will be reimbursed to the County from EBMUD.
II. Financiallmpact:
None to the General Fund. The reimbursement will be made with fees collected from
development in the Tassajara area, specifically for this project. Sufficient developer fees have
been collected pursuant to the Joint Exercise of Powers Agreement to cover this reimbursement
payment.

III. Reasons for Recommendations and Background:
In 1987 the Town of Danville, the City of San Ramon and Contra Costa County entered
into a Joint Exercise of Powers Agreement (JEPA) entitled "Tassajara Area Transpor-
tation Improvement Fees". The JEPA established fees that would be charged for
certain properties developing within the Tassajara area. The fees would fund
improvements in the Town, the City and the County to mitigate the traffic .impacts from
these developing properties. One of the properties identified in the JEPA was the
Bettencourt ranch. The Bettencourt ranch was originally proposed for development
by Braddack and Logan and was subsequently purchased by Dame Construction Company,
who has actually followed through with the construction of the project.
One of the projects listed in the project report of the JEPA was the realignment of
the curve on Camino. Tassajara along the frontage of the Bettencourt Ranch.
Initially, the County was to design and construct the realignment of Camino
Tassajara. However, the developers felt they could perform the improvement on a time
line that would better suit the development of their projects, and proposed to
perform the realignment of the road as part of their subdivision development. The
County concurred, and as a result, Dame Construction Company constructed the
realignment of the road in addition to some major drainage facilities for the Flood
Control District. This reimbursement represents the third installment payment
covering several items of work that are complete.
As part of the overall work on Camino Tassajara, the County called up a deferred
improvement agreement with the Blackhawk Equestrian Center to construct frontage
improvements along their property located on Camino Tassajara at Leema Drive. Dame
Construction Company has performed the work and has requested payment from the County
for the work performed. The County will seek reimbursement from the property owner
pursuant to the deferred improvement agreement.
In conjunction with the road realignment of Camino Tassajara, East Bay Municipal
Utility District installed a new water main. The old water main was abandoned in
place and had to be removed by Dame Construction Company. . Dame Construction Company
is also requesting payment for this work performed. East Bay Municipal Utility
District has agreed to reimburse the County for the costs involved.
IV. Consequences of Negative Action:
Dame Construction Company would not be paid for the work they have done for Contra
Costa County.
