Recommended Action: Approve recommendations from the Transportation Committee as follows: 1. SUBSTITUTE County Wide Area of Benefit fees (CWAOB) assessed on LUP 2040-87 with the following Transportation System Management (TSM) requirements. a. All brochures and tickets shall include information on how to use public transit to get to the California Shakespeare Festival. b. Work with local transit providers to provide service to the site during the season. C. Develop a goal of no more that 20 percent of the patrons and workers will arrive in single occupant vehicles. 2. DIRECT the Public Works Director and the Community.Development Director to work with the applicant to further develop the guidelines and the monitoring mechanisms. II. Financial Impact: The Lamorinda subarea of the CWAOB will have $25,300 less revenue. Reasons for Recommendations and Background: LUP 2040 is a permit to the California Shakespeare Festival (CSF), a non profit organization, for an amphitheater for Shakespearean performances during April 1 and October 30 each year. They requested waiver of fee on the basis of community enrichment, time of performances, and seasonal nature of the performances. The goals of the CWAOB fee is to mitigate traffic impacts, substituting a more vigorous TSM program for the required fee will achieve the same results. In addition, it will provide added benefit in air quality, energy conservation, and public exposure of the transit system. IV. Consequences of Negative Action: The waiver of fees will not be granted and additional TSM requirements will not be imposed.
