THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on June 4, 1991 by the following vote: AYES: Supervisors Fanden, Schroder, Torlakson and Powers NOES: None ABSENT: Supervisor McPeak ABSTAIN: None SUBJECT: Proposed condemnation of real property needed for the construction of a bike path along a portion of Miranda Avenue. This is the time for hearing on the proposed condemnation of real property needed for the construction of a bike path along 'a portion of Miranda Avenue in the Alamo area. Karen McNamer of the Real Property Division of the Public 'Works Department presented the staff report. The Chair declared the public hearing open, and the following persons appeared: Loras M. Lochmann, 2781 Miranda Avenue, Alamo, presented the Board with a set of letters and documents for its review. She advised that the residents of Miranda Avenue are in favor of the addition of a bike path, but have concerns with respect to safety because of excess. speed on Miranda. She suggested, among other things, the addition of two stop signs, bike. crossings, and the restricting of truck traffic. Mrs. Lochmann also expressed concerns for the preservation of the mature rural residential existence of the area. Eileen Frith, 28 Lahoma Court, Alamo, expressed concern about speed, safety issues and drainage. She also suggested stop signs on Easy Street and Roundhill Road. The Chair noted that Dawn Johnan, 291 Acacia Lane, Alamo left a message urging the Board not to delay the bike path project. Melina Burgess, 2805 Lariat Lane, Walnut Creek, left a message in favor of the bike lane. Stephanie Humphries, 3200 Stonegate Lane, Alamo, and Janet Singh, 372 James Bowie Court, Alamo, left messages in favor of proceeding now. Jim Teymourian, 2771 Miranda Avenue, Alamo, left a message requesting that the project be redesigned or reconsidered and that all possible means of speed control be installed. Diana Christensen, 131 Megan Court, Alamo left a message that she agreed with the comments of Loras Lochmann. Loras Lochmann declared that the proposal is to take :property for realignment of the road and the residents want only a bike path. Julie Bueren, Civil Engineer with the Public Works Department, described the engineering procedures proposed for the project and the right-of-way configurations necessary to accommodate the bike path. There being no one else desiring to speak, the Chair declared the public hearing closed. Supervisor-"Schroder commented that bike lane funding is extremely difficult to obtain and that the County has been able to get funds for development of a bike path on Miranda Avenue. He stated that he believes .the residents .really want a bike path, but that the bike path will encroach into the public right-of-way, which is now being utilized as part of the residents' front yards, and that is causing the concern, along with drainage, the speed of traffic and the desire for stop signs. Supervisor Schroder moved to declare .intent to condemn property for the Miranda Avenue bike path, and defer decision to June 11, 1991 to allow time to meet with staff and try to mitigate some of the concerns residents have including traffic, drainage, need for stop signs, elevation of the road and other items mentioned in testimony today. IT IS BY THE BOARD ORDERED THAT the hearing is CLOSED and the Board DECLARES its intent to condemn real property needed for the Miranda Avenue bike path, and decision is DEFERRED to June 11, 1991 at 10:45 a.m. I hereby certify that this Is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the data shown.
