SUBJECT: REPORT ON 1991/92 COUNTY JUSTICE SYSTEM SUBVENTION PROGRAM

RECOMMENDATIONS:
1. Accept Report from the County Justice System Subvention Program Advisory Group
and .the County Administrator on the 1991/92 Subvention Program, hold public
hearing set for 11:00. a.m. , June 4, 1991 and consider adoption of funding
recommendations as follows:

2. Certify to the California Youth authority through a separate Resolution that
1991/92 County Justice System Subvention Program funds will be spent for the
purposes set forth in Section 1806(a) of the Welfare and Institutions Code.

and the Board APPROVED the above recommnedations, adopting Resolution 91/362 certifying
the 1991-91 Subvention Program Application.

b. That each contract contain a condition that it can be terminated without
notice should funds not be appropriated within the final 1991/92 County
budget.
FINANCIAL IMPACT:
Subvention funds support projects that are integral to operation of the County's
justice system. Some are mandated. Without this support, a greater investment of
County general funds would be required. The amounts recommended above are based upon
the FY 1991/92 allocation received from the California Youth Authority which, in turn,
is based upon the Governor's proposed budget. In the Governor's revised budget
released recently, the Subvention Program is placed, within the program realignment
section and may be subject to elimination if the realignment revenue is not
forthcoming to the counties. All AB 90 contracts can be terminated on short notice if
the program is eliminated by the State and funds are not appropriated to the County's
adopted budget.
BACKGROUND REASONS FOR RECOMMENDATIONS:
On May 9, 1991, the Subvention Program Advisory Group met and, in view of the County
budget situation, recommended continuation of existing programs at maintenance levels
as detailed on page 1.
The Subvention Program Advisory Group continues to express its appreciation for the
ability of the various AB 90-funded projects to maintain a high level of service
despite the almost 50% 'reduction of State funding in the program in the current fiscal
year over FY 1989/90. This reduction is carried forward in the .Governor's proposed
91/92 budget. Because of the identification of other funding sources, the Adult
Pre-Trial Diversion project operated by the District Attorney's Office, in cooperation
with the Municipal Courts is not being proposed for FY 1991/92 Subvention funding.
Funds for this program are being identified from other sources including outside
revenue. Thus, the expectation is that the program will continue to function and,
thus, relieve the courts of the burden of dealing with many minor offenders. The
funds previously allocated to Pre-Trial Diversion are being, allocated to the District
Attorney's 3121 program which is mandated by law and which would definitely have to be
covered by the general fund. Departments and agencies implementing various programs
have made a successful and sincere commitment to achieving project objectives and have
made special efforts to insure that levels of service within these programs are
maintained. Other funding sources have been vigorously pursued.
The certification of compliance through separate Board Resolution in recommendation 2
is required by the California Youth Authority by. June 15, 1991.
Four approved projects will require a continuation of existing contracts with the
County. All of these projects are continuing projects. So that there will be no
break in services July 1, I am recommending that the Board of Supervisors, as it did
last year, authorize the County Administrator or his designee to execute on behalf of
the County those contracts for the above-listed projects. The amount approved for the
Criminal Justice Agency includes $39,875 of County general funds, as budgeted within
Budget Unit 0325. Each contract will have a termination clause that permits the
County to eliminat or adjust the contract as dictated by the adopted FY 1991-92 County
Budget.

SUMMARIES OF PROJECTS
CONTRA COSTA COUNTY 1991/92 SUBVENTION PROGRAM
PROJECTS RECOMMENDED FOR FUNDING
PERFORMANCE OF AB 3121 FUNCTIONS
(District Attorney's Office) (State Mandated)
Funds the Juvenile Division which, under AB 3121, is required to be present and
represent the People in all court hearings relating to 602* cases (fitness hearings,
arraignments and pre-trials, contested hearings, detention hearings and disposition
hearings) .
DEFENSE OF JUVENILES
(Public Defender) (State Mandated)
Allows the Public Defender to handle the increased defense workload arising from
AB 3121 requirements.
HOME SUPERVISION
(Probation Department) (State Mandated)
Provides countywide supervision of juveniles (602's) at home in lieu of detention at
Juvenile Hall while awaiting court disposition. Its purpose is to assure that the
minors appear at court hearings, commit no new offenses and obey the conditions of
release.
PLANNING, COORDINATION, EVALUATION AND ADMINISTRATION
(Criminal Justice Agency of Contra Costa County)
This project is designed to provide the County Administrator's Office, Subvention
Program and Dispute Resolution Advisory Groups, and the Criminal Justice Agency
Planning Board with justice planning, coordination, evaluation and administrative
support services. It funds part of the CJA planning functions which include criminal
justice coordination and planning across jurisdictional and departmental lines; grant
and program administration (including Subvention Program and Dispute Resolution
Program administration); funding source development; short-term studies and planning
efforts (including update of the Adult Correctional Facilities Master Plan and
Juvenile Corrections Master Plan); detention facility planning under Propositions 2,
16, 52, and 86, including providing the Sheriff's Department with planning services
related to detention facility programming and opening the new West County Justice
Center.
EAST COUNTY YOUTH AND FAMILY SERVICES
(City of Brentwood, Antioch Police Department, Sheriff)
This regional diversion project operates in the City of Brentwood, the unincorporated
area of East County and the City of Antioch. The program emphasizes short-term family
and individual counseling for misdemeanor offenders -and felons (many will be re-entry
juveniles leaving local correctional institutions) . Services will also be provided
for status offenders in East County.
*Section 602 of the Welfare and Institutions Code places within the jurisdiction of the
juvenile court those who violate Federal or State laws or local ordinances other than
curfew.

BYRON BOYS' RANCH
(Probation Department)
Subsidizes partial costs of Byron Boys' Ranch., an open, non-secure treatment
institution for delinquent boys committed by the Juvenile Court. Normal capacity is
64 beds with expansion to 74 beds when needed. Staffing consists of 1 superintendent,
4 supervisors, 1 Deputy Probation Officer, 11 counselors, and 6 support staff.
DETENTION FACILITY MENTAL HEALTH SERVICES
(Health Services Department)
Provides mental health services at the Martinez Detention Facility to assist the
Sheriff in inmate control and preserving safety of staff and inmates. Mental Health
staff will screen all inmates expected to stay one week or more and those admitted
during nighttime hours. Treatment services will be provided to the mentally
disordered inmates in the medical module and to stabilized inmates in general living
units. Mental Health staff will respond to referrals to inmates by deputies and other
Detention Facility staff.
FRIENDS OUTSIDE
(Friends Outside, Inc. ) (Sheriff's Department)
Continues programs of Detention Facility visiting whereby volunteers interview inmates
and carry out their requests; services to inmates' families; and recruitment, training
and coordination of Detention 'Facility volunteers. Food and clothing for families of
prisoners is provided as needed through donations.
BATTERING ABATEMENT TRAINING PROGRAM
(Battered Women's Alternatives)
Provides treatment services to men who physically abuse their spouses. Clients will be
referred from law and justice agencies throughout the criminal justice process as well
as from sources outside the justice system (crisis line callers, support group
participants)'. Priority will be given to offenders participating in domestic violence
diversion per Penal Code Section 1000.6.
