HomeMy WebLinkAboutMINUTES - 06041991 - 1.125 ;J� 1. 125 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUN'T'Y, CALIFORNIA Adopted this Order on June 4, 1991 by the following vote: AYES: Supervisors Schroder, -Torlakson and Powers NOES: None ABSENT: Supervisors Fanden and McPeak ABSTAIN: None SUBJECT: County Counsel' s Report of. the Contra Costa County Feeder Trail #1. The Board received a May 28, 1991 report from County Counsel responding to the Board's referral of an April 1, 1991 letter from Roxann Crosby relating to the Contra Costa County Feeder Trail # 1. The following persons appeared to comment on the matter: Roxann Crosby, 2711 Geneva Street, Martinez, who urged that the County reaffirm the status of the feeder trail and who submitted letters from her young children asking that the County save the trail. She submitted a petition signed by 10 persons, asking that the trail be saved. Michael Crosby, Age 5, and Saundra Fouhy, Age 4, addressed the Board and urged them to protect the trail. George Cardinet, Heritage Trails Friends,. 5301 Pine Hollow, Concord 94520 advised that Feeder Trail #1 is a bona fide trail, and recited his memories of its establishment, dedication and use. He commented that he had just ascertained that it is in the County' s new General Plan as part of the riding trail element. Julian Frazer, 2415 Alhambra Avenue, Martinez commented on the history of the dedication and the current use of the trail, and the County' s intent that the trail be used by riders and hikers. Chairman Powers noted that there were other members of the audience who had completed Request- to Speak Forms, but that this is not a public hearing, and the matter under consideration is a legal question, not a matter of intent or desire. He noted that the County is involved in litigation relative to this matter. County Counsel advised that his office has reviewed all of the material submitted. He further noted that there was a lawsuit filed some months ago. Chairman Powers commented that the Board understands the concerns of the trail users, but this is a legal issue and one that the Board cannot deliberate in public. Supervisor Schroder moved to accept the report from County Counsel. r County Counsel advised that if the people concerned would contact his office tomorrow, he will be glad to arrange a meeting and discuss with them what the County is doing.
